Let’s hear it one more time for Education!

First, allow me to thank everyone who responded to my previous blog post regarding certification.  It has been an honor and a privilege to receive so many e-mails as well as comments on this as well as other blogs that picked up the post.
 
Since the majority of your responses focused on the field of education rather than certification, this post will be dedicated exclusively to it.  I think most would agree that e-discovery and the practice support industry are in dire need of solid and unbiased education.  So before you commit your hard-earned and heavily fought-for budget money to an education course, ask yourself the following questions:

E-Discovery Certification - Reality or Myth?

A question of Litigation/Practice Support (and more recently E-Discovery) certification is as old as the industry itself. After all the concept of certification is quite common in the legal field considering that attorneys and to a certain degree the legal assistants are required to be certified.  So why not Litigation/Practice Support or E-Discovery specialists?

Reflections on Progress in E-Discovery Education

Electronic discovery is not a topic typically associated with merrymaking.  Instead, e-discovery more typically brings to mind thoughts of risk, sanctions, cost and other assorted ills that are not on anyone’s holiday present wish-list.   But as we approach the end of the year and enjoy the warm glow of holiday spirit we should focus on positive developments in the field.   The e-discovery “community” should look back with some sense of satisfaction at the improvements it has worked so hard to achieve in the arena of professional awareness and education about e-discovery.  In recent years, the increase in the numbers of lawyers and legal professionals becoming aware of and in even sophisticated about e-discovery issues stands out as a positive trend moving the field forward in the right direction.  No one would suggest that there isn’t a lot more to be done; however, the empty part of the glass should not make us blind to the part that is filled.

2009 U.S. and EU Conference on Cross Border Data Flows, Data Protection & Privacy

The 2009 Conference on Cross Border Data Flows, Data Protection and Privacy, entitled:  “Across the Divide: Successfully Navigating Safe Harbor” was held in Washington, D.C. from November 16-18, 2009.  The conference was organized by the United States Department of Commerce with the participation and cooperation of the European Commission and the Article 29 Working Party on Data Protection.

International Clash of Cultures and Law: Cross-Border E-Discovery

On November 12, 2009, an all-star cast of international e-discovery and data privacy experts presented a panel on “Clash of Laws and Cultures: Cross Border E-Discovery and International Data Management” at the Six Annual Georgetown Advanced E-Discovery Institute:  Identifying Today’s Problems & Tomorrow’s Solutions.
 
Panelists from the United States, France and Switzerland, representing the perspectives of in-house counsel, local outside counsel in an E.U. country, as well as outside complex litigation and privacy law counsel from the United States explained why civil litigants remain between a rock and a hard place in managing the risk of cross-border transfers of personal data in the context of international litigation.
