E-Discovery and Information Management

In my last blog posting, I discussed e-Discovery in an untethered world and highlighted the e-discovery challenges associated with mobile devices such as the iPad.  Today I’m going to talk about a way to reduce the cost and complexity associated with preservation and collection of these devices – information management.  This is not new – ARMA International has been around since 1955.  However, the centralization, storage, and management of information is becoming more critical than ever in today’s electronic, all-access world.

E-Discovery in an Untethered World

Earlier this month, Apple released the iPad to the general public.  There has been considerable discussion as to whether a device such as the iPad, with functionality between a smart phone and a laptop, will appeal to users.  In the last month, I’ve certainly seen a number of emails with a “Sent from my iPad” signature line.   As such, devices such as the iPad are worth evaluating and discussing from a discovery perspective.

Introducing Hedge Funds and Private Equity Firms to E-Discovery

The details of rules regulating “alternative investment” funds like hedge funds and private equity firms are as yet uncertain.  But we do know that they will include new requirements to retain and disclose ESI.  Proposed legislation such as the “hedge fund transparency act” even emphasizes this fundamental truth in its title.  While some of the larger firms saw the writing on the wall in terms of heightened regulatory scrutiny years ago, the alternative investment players who can be counted among those who proactively prepared for a more demanding legal compliance regime are few, and typically limited to the largest and best known firms doing the largest and most highly publicized deals.

Hearts and Minds

It is almost two months since my posting appeared here entitled “Be Not Diminished.” It received a number of cogent comments (and critiques); that told me that what I believed to be the meaning behind my commentary had not been well-understood and that the lack of clarity was, most likely, my own fault. I was certainly not trying to defend “schlocky” e-discovery service providers or even, primarily, complain about the state of the business of vendors in general (which is, however, pretty grim in these fraught times).

Social Media: The Next Frontier in E-Discovery

Not too long ago I was having a conversation with someone about the importance of social media in marketing strategies.  Many companies have links to their Facebook and Twitter sites in their contact information.  A simple search on Amazon.com for social media marketing returns hundreds of books on the subject.  The social media sites themselves are also embracing marketing - Facebook has an entire Facebook page dedicated to Marketing Solutions.   More companies are embracing social media each day – it is not just a fad.

Mitigating Risk in an Industry Filled with Technological Goliaths

With each new technology comes a new challenge. Like David’s plight to slay Goliath, the practitioner encounters the e-discovery giant with each emerging technology. Keeping up with today’s trends is not an easy task. The moment the legal industry thinks it has conquered one technology, another steps in to take its place. And, if that is not enough, upgrades and modifications to current configurations and protocols occur just as frequently.

Reflections on Progress in E-Discovery Education

Electronic discovery is not a topic typically associated with merrymaking.  Instead, e-discovery more typically brings to mind thoughts of risk, sanctions, cost and other assorted ills that are not on anyone’s holiday present wish-list.   But as we approach the end of the year and enjoy the warm glow of holiday spirit we should focus on positive developments in the field.   The e-discovery “community” should look back with some sense of satisfaction at the improvements it has worked so hard to achieve in the arena of professional awareness and education about e-discovery.  In recent years, the increase in the numbers of lawyers and legal professionals becoming aware of and in even sophisticated about e-discovery issues stands out as a positive trend moving the field forward in the right direction.  No one would suggest that there isn’t a lot more to be done; however, the empty part of the glass should not make us blind to the part that is filled.
