The Georgetown Environmental Law & Policy Institute published Global Warming in the Courts: An Overview of Current Litigation and Common Legal Issues, a report examining the “boomlet” in
global warming litigation in federal and state courts. Authored by GELPI Fellow Justin Pidot, the report identifies the several cross-cutting issues raised by global warming litigation. The report
also identifies four primary categories of ongoing litigation related to global warming, including cases filed under the Clean Air Act, the National Environmental Policy Act, common law of nuisance, and federal preemption doctrine.
