1. General

This Disclaimer and User Agreement sets forth the terms and conditions of a license for you to use the Global Database on the Guiding Principles on Internal Displacement (Global Database). By accessing and/or using the Global Database, you agree to comply with all of the terms and conditions of this Disclaimer and User Agreement. From time to time, these terms and conditions may be modified and subsequent use of the Global Database will imply consent to those changes as well. Accordingly, please continue to review this Disclaimer and User Agreement as posted on the Global Database web site whenever accessing or using the Global Database.

2. Nature of the Service

The Global Database is provided as an information service only and does not constitute legal advice. While the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement will seek to continuously update the Global Database, the information herein may not be entirely up-to-date or complete. This is particularly true with regard to the information and documents on national law which this database does not comprehensively cover.

3. Copyright and Proprietary Information

The Global Database contains copyrighted material and/or other proprietary information that is protected by intellectual property agreements and copyright laws and regulations worldwide. Some of the documents provided herein are owned by persons or entities
other than the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement and are used here by permission of the owners subject to the application of the limited license described in paragraph 4. The database structure, coding, and website content are the property of the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement.

4. Limited Use License

You are hereby granted a non-transferable license to use, download and print the materials contained in the Global Database solely for non-commercial purposes in accordance with this Disclaimer and User Agreement. The database materials may be reproduced for educational and legal advocacy purposes. You may not alter or remove any copyright symbol or other identification concerning authorship of any of the materials contained on or otherwise made available to you in the Global Database. Except as may otherwise be expressly permitted, any commercial redistribution or commercial publication of any material contained on or otherwise made available to you on the Global Database is strictly prohibited. Likewise, all forms of sub-licensing, reselling, republication or other commercial forms of redistribution of any of the data or software used in the Global Database, including Internet posting, electronic mailing, faxing, archiving in a public database, redistributing via a computer network or in printed form, to any third party, are strictly prohibited. The Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement may deny you access to all or part of the Global Database without notice if you engage in any conduct or activities that they believe violates any term of this Agreement.

5. No Implied Endorsement

The designations and search criteria used in the Global Database do not imply the expression of any opinion on the part of the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement concerning the legal status of a territory or of any of the documents listed herein. The material or information in the Global Database does not necessarily represent the official views or position of the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement.

6. Disclaimer of Warranty and Liability

Neither the Institute for the Study of International Migration at Georgetown University, the Brookings/Bern Project on Internal Displacement employees, agents, third-party
Content providers, or licensors warrant that access to and use of the Global Database will be free from interruptions or free from errors, nor that any information accessible from or related to the data is free of viruses, worms, or other harmful components. No warranty is made as to the results that may be obtained from use of the global database, or as to the accuracy, reliability, or content of any information or service provided

The Global Database is provided "as is" without any warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose. In no event shall the Institute for the Study of International Migration at Georgetown University, the Brookings/Bern Project on Internal Displacement be liable to you or any other person for any loss of business or profits, or for any indirect, incidental or consequential damages arising out of any use of, or inability to use, the Global Database even if the Institute for the Study of International Migration at Georgetown University, the Brookings/Bern Project on Internal Displacement is previously advised of the possibility of such damages, or for any other claim by you or any other person.

You further expressly acknowledge and agree that information, text, graphics, and hyperlinks provided to you through the Global Database and located on other sites throughout the combined global electronic networks known as the Internet and the World-Wide-Web are provided solely as a resource and a convenience to you. Such hyperlinks to other sites are not an endorsement by the Institute for the Study of International Migration at Georgetown University, the Brookings/Bern Project on Internal Displacement of those sites. The Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement make no warranty, either express or implied, as to the accuracy, reliability, or content of such information, text, graphics, and hyperlinks.

7. Indemnification

You agree to defend, indemnify and hold the Institute for the Study of International Migration/Georgetown University and the Brookings/Bern Project on Internal Displacement and its employees harmless from any and all damages, liabilities, costs and expenses, including attorneys' fees, related to any violation of this Agreement by you or any of your agents.

8. Privileges and Immunities

Nothing in or relating to this Disclaimer and User Agreement shall be deemed a waiver of any of the privileges and immunities of the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement

9. Arbitration and Governing Law

Any claims against the Institute for the Study of International Migration at Georgetown University and the Brookings/Bern Project on Internal Displacement, their staff and volunteers, and their third party content providers and licensors concerning or arising from the use of the Global Database on the Guiding Principles on Internal Displacement shall be governed by the laws of the District of Columbia. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in Washington, DC, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

10. Miscellaneous

This Disclaimer and User Agreement constitutes the entire agreement and understanding
between the Institute for the Study of International Migration at Georgetown University, the Brookings/Bern Project on Internal Displacement and you with respect to the subject matter hereof. The provisions of this User Agreement shall inure to the benefit of the Institute for the Study of International Migration/Georgetown University, the Brookings/Bern Project on Internal Displacement, its staff and volunteers, and its third-party content providers and licensors.
