Amici Curiae in a Recent NAFTA Case

In a recent Decision on Authority to Accept Amicus Submissions, dated 15 January 2001, in the above mentioned NAFTA investor-state-dispute, a NAFTA panel decided to accept amicus curiae briefs in the case at hand. Of course the NAFTA setting is different from the dispute settlement in the WTO, but some arguments could be invoked under the DSU as well and the reasoning and writing of the panel is insightful.
