Applicant, owner of 443 M Street, N.W. (a building found to contribute to the significance of the Mount Vernon Square Historic District), installed several vinyl windows without the permit for exterior work required under the Act. When the Applicant failed to appear at her scheduled hearing before the Mayor’s Agent, the Mayor’s Agent entered a default judgment adopting the recommendation of the Historic Preservation Review Board, concluding that the windows were incompatible with the character of the historic district. He subsequently ordered the Applicant to remove and replace the windows.
The Mayor’s Agent entered a default judgment against the Applicant after she failed to attend her hearing without formally withdrawing her request. Although Applicant allegedly called a staff member of the Historic Preservation Office to withdraw her request for a hearing, she never forwarded the withdrawal to the Mayor’s Agent. The default judgment had the effect of reaffirming the Historic Preservation Review Board’s determination against approval of the application.
Applicant installed several vinyl replacement windows on her contributing building in the Mount Vernon Square Historic District without a permit. Upon Applicant’s failure to attend the scheduled hearing, the Mayor’s Agent, adopting the findings and recommendations of Historic Preservation Review Board, concluded that the windows were of a style that was not compatible with the character of the historic district, and thus violated the Act.
