O’Neill Institute Presents Joint Report Before CEDAW on Tobacco Control Policies and Women. Featured in an article in the Clarin, an Argentinean newspaper’s website, the O’Neill Institute, with other civil society organizations, presented its findings before CEDAW, noting “global prevalence of tobacco use among women will increase by 20% by the year 2025.” Furthermore, one in three Argentinean women is affected by tobacco-related illnesses and tobacco use among females is increasing at an earlier age.

9 a.m. to 1:30 p.m. - Health law scholars and policy experts will convene at the law school to analyze how particular issues of law have fared and are likely to fare in the continuing effort to enact health reform legislation. The conference will build on the “Legal Solutions” papers commissioned last year on such topics as an individual mandate to purchase insurance, insurance exchanges, and discrimination in health reform (overview available here), as well as new research on additional issues.

Anand Grover is a leading figure in efforts to use law to advance the rights of those living with, or vulnerable to, HIV/AIDS in India. As the director and co-founder of the Lawyers Collective, he has handled hundreds of HIVoriented cases in India on issues ranging from discrimination to access to medicines. He recently argued Naz Foundation Trust v. Government of NCT, Delhi and Others, in which the Delhi High Court struck down the criminal prohibitions relating to sodomy in the Indian Penal Code.

On September 25, the O’Neill Institute for National and Global Health Law at Georgetown University welcomed His Excellency Dr. Tedros Adhanom Ghebreyesus, Minister of Health of the Federal Democratic Republic of Ethiopia. Minister Tedros visited to honor Ambassador Mark R. Dybul, O’Neill Institute Distinguished Visiting Scholar and Co-Director of the Global Health Law Program for his contributions to global health and the health of Ethiopia.Of Amb. Dybul, Minister Tedros said, “He is one of the most gifted, hard-working, principled, compassionate and committed people I have had the privilege to know - an outstanding leader and a truly exceptional human being.”
Dr. Tedros and Amb. Dybul both discussed the critical role of country leadership in combating health threats. “So much is said of country ownership in development discourse these days. Yet, I have known so few who have upheld this critical cornerstone of successful development as consistently as Mark Dybul has,” said Dr. Tedros. After accepting Minister Tedros’ recognition, Ambassador Dybul also discussed the role of country leadership in development. “We have this horrible notion in development that we are coming to help poor, uneducated people. Nothing could be further from the truth. We go to support extraordinary human beings and learn a great deal in return.”
Minister Tedros is widely regarded as a leading public figure in global health. He has led Ethiopia’s Ministry of Health since 2005. He is also the chair of the Global Fund to Fight AIDS, Tuberculosis, and Malaria. Until May, 2009, he chaired the Roll Back Malaria Alliance Partnership.
Ambassador Dybul is an O’Neill Institute Distinguished Visiting Scholar and Co-Director of the Global Health Law Program. Prior to joining the Institute, he served as the United States Global AIDS Coordinator. In that role, he led the implementation of the President’s Emergency Plan for AIDS Relief (PEPFAR), the largest international health initiative in history for a single disease.

HHS Releases Reports on Health Information Security and Privacy Collaboration (HISPC)

As part of the Health Information Security and Privacy Collaboration (HISPC), the Department of Health and Human Services released a compendium of reports detailing variations in state law, business practices and policy related to privacy and security and the electronic exchange of health information. O’Neill Distinguished Scholar Joy Pritts authored four of these reports, with law fellow Elenora Connors as a co-author for the report on state prescribing laws:

Planning for Pre-exposure Prophylaxis Conference

Funded by the Bill & Melinda Gates Foundation, the O’Neill Institute sponsored the conference in London, United Kingdom, on June 18-19. Chaired by Ambassador Mark R. Dybul, the conference served as a launching point to organize critical thought on the impending results of the ongoing pre-exposure prophylaxis (PrEP) trials within the field of HIV/AIDS prevention and treatment programs.

Global AIDS Funding in an Era of Uncertainty

Dr. Peter Mugyenyi, the founding director of Uganda’s HIV/AIDS Joint Clinical Research Center, and Ambassador Mark R. Dybul, the former U.S. Global AIDS Coordinator, shared their perspectives on the President’s Emergency Plan for AIDS Relief (PEPFAR) and their work to combat the global AIDS crisis. The event was sponsored by Georgetown’s Africa Interest Network (GAIN) and the advocacy group Physicians for Human Rights (PHR).

Making New Medicines Accessible to All: The Health Impact Fund

Georgetown University and Incentives for Global Health hosted the symposium Making New Medicines Accessible to All: The Health Impact Fund.Pharmaceuticals hold the promise of saving many lives around the world. However, the cost of research and development of new medicines is often prohibitive. To provide wide access to the most effective pharmaceuticals, prices need to be low enough for people to afford—but low prices do not create strong incentives for innovators to invest in research and development.
The Health Impact Fund (HIF) is a new way of stimulating research and development of life-saving pharmaceuticals. The proposed Fund is an optional mechanism that offers pharmaceutical innovators a supplementary reward based on the health impact of their products if they agree to sell those products at cost. This Fund is to be financed mainly by governments and will incentivize innovation and increase access to medicines that meet critical health needs.

The American launch of the HIF was held on the afternoon of December 1st at Georgetown University, building on momentum from a series of international forums and events. This event helped raise awareness and support for this new mechanism at a moment of transition between presidential administrations. Invited participants included prominent members of the academic, corporate and governmental sectors, and it was held on the same day as World AIDS Day, December 1st.

Dr. Julie A. DeLoia is the Associate Dean of Academic Affairs at the School of Nursing & Health Studies at Georgetown University Medical Center. Previously, Dr. DeLoia held various academic appointments and leadership positions at the University of Pittsburgh School of Medicine. She was instrumental in founding the University of Pittsburgh’s Ovarian Cancer Center and served as the center’s director of research.Dr. Kevin T. FitzGerald is a Research Associate Professor in the Division of Biochemistry and Pharmacology of the Department of Oncology and the David Lauler Chair for Catholic Health Care Ethics. He is also a member of the Center for Clinical Bioethics, the Advisory Board for the Center for Infectious Disease (CID), and the Angiogenesis, Invasion, Metastasis Program at the Lombardi Cancer Center.
The panel was moderated by Professor John Monahan of Georgetown Law.

This session of the O’Neill Institute’s Colloquium, “National and Global Health Law” explored the issue of public health and chronic disease. The panelists discussed the underlying causes and associated public health consequences of chronic disease, such as rising health care costs. In the discussion, they also explored prevention, treatment, and regulatory strategies to address the issue. The panelists for this session were Professor M. Gregg Bloche, Professor Angela J. Campbell, and Dean Wendy Collins Perdue. It was moderated by O’Neill Institute Director Lawrence O. Gostin.

The Fogarty International Center (FIC) at the National Institutes of Health is celebrating its fortieth anniversary in 2008. In honor of this anniversary, the O’Neill Institute partnered with FIC and the Office of Georgetown University President Jack DeGioia to plan a major keystone event entitled “The Role of Science in Advancing Global Health Diplomacy.” This one-day event, held on November 12, 2008, consisted of multiple sessions and involved the participation of an interdisciplinary group of experts from scientists and physicians to government policy makers, academics, and representatives from major NGOs, IGOs, funding agencies, and field practitioners.Numerous resources from the event are available online:

Now What? Legal Solutions in Health Reform

During the historic presidential campaign of 2008, health reform was discussed and debated at both the federal and state level, in legislatures and campaigns, in focus groups and on editorial pages. There are big issues, such as the model: should it be medical savings accounts, pay-for-play, or single payor? There are more technical ones: what should be the threshold poverty level for subsidies, the cost-sharing for preventive services, or the payment for “never events.”Sometimes lost in these debates are issues that are legal, whether constitutional, statutory, or regulatory in nature. Sometimes they are viewed (and sometimes they are portrayed) as insoluble barriers to needed reform. This session will focus on practical solutions to these important questions.
This presentation of the O’Neill Institute’s Colloquium examined the question of “Now What? Legal Solutions in Health Reform.” Speakers included Professor Tim Westmoreland, Georgetown Law, Professor Jacqueline Scott, Senior Fellow and Adjunct Professor at the Harrison Institute, Georgetown Law, Sheila P. Burke and Jack Ebeler, O’Neill Institute Distinguished Visitors.
This presentation was hosted in conjunction with the Harrison Institute for Public Law of Georgetown Law, and is a part of an ongoing Robert Wood Johnson Foundation funded O’Neill Institute project on Legal Issues in Health Reform.

National and Global Health Law: O’Neill Institute Inaugural Colloquium

The goal of the O’Neill Institute’s inaugural colloquium is to engage leading thinkers and students in an enriching dialogue surrounding critical health law issues. National and international scholars, practitioners and policymakers will explore contemporary health law issues with top students interested in health law from schools throughout the University. Colloquium sessions will also be open to Georgetown University faculty members and interested members of the public. The course will be jointly taught by Professors Gostin and Monahan. One of them, or another member of the O’Neill Institute faculty, will serve as the moderator for each session—during which experts, faculty and students will explore and analyze the issues selected for consideration. The exact format for each session will depend upon the issue and speaker, and may range from a presentation of a cutting-edge paper or an interview to participation in a debate or a structured dialogue. This course will cover diverse topics such as the 2008 presidential campaign, global health governance, intellectual property’s relation to health, and many others. Task Force for Ethical Recruitment of Foreign-Educated Nurses

The O’Neill Institute is partnering with AcademyHealth to assist a group of diverse stakeholders craft a voluntary code of conduct for recruitment of foreign-educated nurses by United States employers. Specifically, Professors Gostin and Monahan have chaired Task Force meetings in which U.S. companies and hospitals that are currently recruiting foreign-educated nurses examine strategies for reducing the harm and maximizing the benefits for the United States, source countries, and nurses interested in migration. The O’Neill Institute is helping facilitate a consensus-building process with recruiters, hospitals and foreign trained nurses and drafting “standards of practice” for consideration by the Task Force members. Task Force members include distinguished Georgetown faculty, including Katherine Leonhardy (NHS), Sheila Burke (Distinguished Visitor, O’Neill Institute) and Andrew Schoenholtz (Center for Study of Migration). The project will end with a joint proposal by these organizations to disseminate and promote its endorsement.

The O’Neill Institute partnered with NHS to convene a scholarly forum on opportunities and challenges of personalized medicine, led by a committee which included Julie Deloia (Assistant Dean, NHS), Kevin Fitzgerald (Faculty, Medical Center) Irene Jillson (Faculty, NHS), and John Monahan (Executive Director, O’Neill Institute). Georgetown Press will publish a book that includes perspectives shared at the conference.

World Malaria Day

Partnering with the Mortara Center for International Studies, the O’Neill Institute is helping to organize a series of Georgetown events for the first annual World Malaria Day (April 25, 2008). The interdisciplinary group of faculty heading this collaboration has invited some of the world’s leading malaria scientists and policy makers to attend a one-day symposium that will focus on scientific progress and emerging policy challenges. Brookings-O’Neill Health Care Cost Containment Conference

Uncontrolled medical spending has risen to the top of the national agenda and become a fiercely-contested election year issue.This conference, co-sponsored by the O’Neill Institute and the Brookings Institution, considered why past efforts to contain costs have failed and how America might achieve cost-sensitive health care reform in the future.
At the March 7th conference, former Senate Majority Leader Tom Daschle offered opening remarks on how to achieve change in today’s political climate, and Congressional Budget Office Director Peter Orszag delivered the luncheon address.
The conference panelists, who included many of the nation’s top experts on health policy, came from a variety of disciplines and political perspectives.
At the end of this year, The Brookings Institution Press will publish a volume, edited by Gregg Bloche and Leslie Meltzer, entitled Beyond Learned Helplessness: Solving America’s Health Care Cost Conundrum. Gostin delivered a keynote address and chaired an expert panel at a health conference at the University of Sydney (Australia).The conference, entitled Business as Usual? Debating the Role of Industry in Meeting the Challenges of Chronic Disease, featured three topical sessions, each featuring a keynote address, followed by a second topical speech and a Q & A session.
Professor Gostin delivered the first Keynote of the day: Public Health Regulation: A Systematic Evaluation. Then, he served as the Chairperson of the second session of the day.

DiClemente is the Charles Howard Candler Professor of Public Health at Emory’s Rollins School of Public Health and associate director of the Emory Center for AIDS Research. Wingood is associate professor and director of graduate studies of behavioral science and health education at the Rollins School of Public Health. Wingood’s research focuses on HIV and women’s health.

The O’Neill Institute for National and Global Health Law was recently established with a foundational gift from Linda and timothy O’Neill. The Institute’s mission is to find innovative solutions for the most pressing health concerns facing the nation and the world through research, scholarship, and reflective engagement with partners in the public and private sectors.I now have the great pleasure to announce the appointment of John Monahan as the Executive Director of the O’Neill Institute for National and Global Health Law. We are thrilled to bring John’s experience, wisdom, and leadership to Georgetown Law. As an alumnus of both Georgetown’s undergraduate and law schools, John is returning to his academic roots to build this exciting new enterprise.
John’s distinguished career has spanned many health-related fields: public service, philanthropy, law, and political campaigns. Most recently, John served as Senior Fellow to the Annie E. Casey Foundation, advising the grant-maker on strategies for increasing the relevance and impact of their programs for federal, state, and local policymakers. He also holds an appointment as a Senior Fellow at the Brooking’s Institution’s Center for Urban and Metropolitan Policy.
From 1993 to 1999, John held senior positions at the U.S. Department of Health and Human Services. In 1993-1996, he served as Director of Intergovernmental Affairs and represented the department before governors, mayors, and other state and local officials, playing a major role in negotiating innovative health and welfare waivers with states. In 1996-1999, he also served as Principal Deputy Assistant Secretary for Children and Families, the second-ranking official in an agency that has an annual budget exceeding $35 billion and that oversees TANF, child support, Head Start, and more than thirty other programs serving low-income families and communities.
From 1990 to 1992, Monahan worked as Legal Counsel to Senator David Pryor, including providing staff support to the senator in his service on the Senate Ethics Committee during the Keating Five case. In 1989, he was an Investigator for the Senate Special Committee on Aging.
A veteran of numerous campaigns, Monahan served as field director in the Clinton campaign in 1992 and held senior positions in the Democratic National Committee and in the Presidential Transition in 1992-1993. He began his career as a field organizer for Mondale for President.
John is an energetic and skilled leader, and we lo look forward to working with him to build the O’Neill Institute a premier source of health law and policy.
