FAIR v. Rumsfeld
Brought by an organization consisting of 36 law schools and law faculties, this suit went before the U.S. Supreme Court, which upheld the constitutionality of the Solomon Amendment, reversing the Third Circuit's decision that the Solomon Amendment violated the First Amendment.
Burt v. Rumsfeld
SAME v. Rumsfeld
These Solomon challenges were brought by professors and students at Yale Law School, respectively. In its January 2005 decision in Burt, the Connecticut district court declared the Solomon Amendment unconstitutional and enjoined its enforcement against Yale. The district court dismissed SAME as moot in light of Burt. Burt is currently pending before the Second Circuit.
Burbank v. Rumsfeld
A case brought by faculty at the University of Pennsylvania Law School raising statutory as well as constitutional claims against the Solomon Amendment. This case is before the Eastern District of Pennsylvania, which previously stayed the case, pending a disposition in FAIR.
