The court held that the defendant\u2019s statement,\u00a0\u201cThis\u2014I guess where, I, I\u2019m going to take my rights . . . \u201d was an\u00a0invocation of the right to remain silent, regardless of the wavering words\u00a0\u201cI guess\u201d and the defendant\u2019s follow-on assertion that he wanted to\u00a0continue helping the police. The defendant\u2019s ambiguous invocation\u00a0could have resulted from the failure of the Miranda warning he received\u00a0to specify how to assert his rights.
