{"id":1929,"date":"2023-05-26T16:46:35","date_gmt":"2023-05-26T20:46:35","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/american-criminal-law-review\/?page_id=1929"},"modified":"2025-05-12T11:09:19","modified_gmt":"2025-05-12T15:09:19","slug":"progressive-prosecutors-or-zealous-defenders-from-coast-to-coast","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/american-criminal-law-review\/in-print\/volume-60-number-4-fall-2023\/progressive-prosecutors-or-zealous-defenders-from-coast-to-coast\/","title":{"rendered":"Progressive Prosecutors or Zealous Defenders, From Coast-to-Coast"},"content":{"rendered":"<p><span id=\"page1546R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">This Article challenges the narrative that the progressive prosecutor movement <\/span><span dir=\"ltr\" role=\"presentation\">can meaningfully transform the criminal legal system and argues that the myopic <\/span><span dir=\"ltr\" role=\"presentation\">focus on prosecutors as the solution to all that ails this system further diminishes <\/span><span dir=\"ltr\" role=\"presentation\">the critical, and chronically under-resourced, role of the public defender.<\/span><\/span><span id=\"page1546R_mcid13\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p><span id=\"page1546R_mcid131\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In presenting this claim, we do not question the sincerity of many self-styled <\/span><span dir=\"ltr\" role=\"presentation\">progressive prosecutors\u2019 desires to<\/span> <span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">make a difference<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span> <span dir=\"ltr\" role=\"presentation\">in the criminal legal<\/span><\/span><span id=\"page1546R_mcid14\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">sys<\/span><span dir=\"ltr\" role=\"presentation\">tem<\/span><\/span><span id=\"page1546R_mcid16\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">or whether these prosecutors have in fact modified norms and practices<\/span><\/span><span id=\"page1546R_mcid17\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">posi<\/span><span dir=\"ltr\" role=\"presentation\">tively<\/span><\/span><span id=\"page1546R_mcid19\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">in some jurisdictions. But in our view, the record reveals mostly modest <\/span><span dir=\"ltr\" role=\"presentation\">changes and substantial, multidirectional resistance to anything more. And this <\/span><span dir=\"ltr\" role=\"presentation\">record should not be a surprise, as prosecutors are executive branch officers <\/span><span dir=\"ltr\" role=\"presentation\">with a job description primarily of charging and punishing crime in an<\/span><\/span><span id=\"page1546R_mcid20\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">adversa<\/span><span dir=\"ltr\" role=\"presentation\">rial<\/span><\/span><span id=\"page1546R_mcid22\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">system. The progressive prosecutor movement nevertheless has become <\/span><span dir=\"ltr\" role=\"presentation\">another way for prosecutor offices to expand their mission, deepen their<\/span><\/span><span id=\"page1546R_mcid23\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">resour<\/span><span dir=\"ltr\" role=\"presentation\">ces,<\/span><\/span><span id=\"page1546R_mcid21\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and accrue power to do<\/span> <span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">justice.<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span><\/span><span id=\"page1546R_mcid25\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p><span id=\"page1546R_mcid251\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">We emphasize a different path to meaningful change: well-resourced, highly <\/span><span dir=\"ltr\" role=\"presentation\">functioning public defense systems. We do not claim that public defenders are a <\/span><span dir=\"ltr\" role=\"presentation\">panacea or a comparable solution to abolition. But we explore how a greater <\/span><span dir=\"ltr\" role=\"presentation\">commitment to public defense more meaningfully can change the lives of people <\/span><span dir=\"ltr\" role=\"presentation\">and communities impacted by our criminal legal system by empowering the<\/span><\/span><span id=\"page1546R_mcid26\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">pro<\/span><span dir=\"ltr\" role=\"presentation\">fessionals<\/span><\/span><span id=\"page1546R_mcid28\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">with the role and training, the professional incentives, and the<\/span><\/span><span id=\"page1546R_mcid31\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">institu<\/span><span dir=\"ltr\" role=\"presentation\">tional<\/span><\/span><span id=\"page1546R_mcid27\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">values to pursue material and sustainable change.
