{"id":805,"date":"2022-06-08T22:05:37","date_gmt":"2022-06-09T02:05:37","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/gender-journal\/?page_id=805"},"modified":"2025-05-12T11:10:36","modified_gmt":"2025-05-12T15:10:36","slug":"abortion-protesting","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/gender-journal\/in-print\/volume-xxiii-issue-2-annual-review-2022\/abortion-protesting\/","title":{"rendered":"Abortion Protesting"},"content":{"rendered":"<p><span style=\"font-weight: 400\">The Supreme Court in 1973 recognized abortion as an exercise of a fundamental privacy right grounded in the Constitution.<\/span><span style=\"font-weight: 400\">\u00a0<\/span><span style=\"font-weight: 400\">Abortion nevertheless remains controversial, surrounded by emotionally charged debates that combine political, <\/span><span style=\"font-weight: 400\">gender, and healthcare issues. <\/span><span style=\"font-weight: 400\">Accordingly, people express their views on abor<\/span><span style=\"font-weight: 400\">tion through various forms of advocacy and protest. The right to protest is at the core of free speech, protected by the First Amendment.<\/span><span style=\"font-weight: 400\">\u00a0<\/span><span style=\"font-weight: 400\">The 1960s civil rights movement used protest successfully to educate the public and ultimately bring about changes in the law. <\/span><span style=\"font-weight: 400\">Abortion protesting differs from other forms of pro<\/span><span style=\"font-weight: 400\">testing, however, because of the competition between the decisional privacy rights guaranteed to abortion seekers and the free speech rights of abortion protesters.<\/span><\/p>\n<p><span style=\"font-weight: 400\">By linking abortion with fundamental constitutional rights,<\/span><span style=\"font-weight: 400\">\u00a0<\/span><i><span style=\"font-weight: 400\">Roe v. Wade <\/span><\/i><span style=\"font-weight: 400\">set the stage for debate over access to abortion services and rights associated with abortion protesting. Since <\/span><i><span style=\"font-weight: 400\">Roe<\/span><\/i><span style=\"font-weight: 400\">, anti-abortion activists have organized efforts to <\/span><span style=\"font-weight: 400\">protest the legality of abortion. <\/span><span style=\"font-weight: 400\">On occasion, abortion protestors have directly <\/span><span style=\"font-weight: 400\">prevented women from obtaining abortion services. <\/span><span style=\"font-weight: 400\">Although the First <\/span><span style=\"font-weight: 400\">Amendment protects an individual\u2019s right to protest,<\/span><span style=\"font-weight: 400\">9 <\/span><span style=\"font-weight: 400\">anti-abortion protesters\u2019\u00a0 actions exceeded the parameters of constitutionally protected free speech when <\/span><span style=\"font-weight: 400\">those actions involved violence and threatening behavior.<\/span><span style=\"font-weight: 400\">\u00a0<\/span><span style=\"font-weight: 400\">In response, abortion <\/span><span style=\"font-weight: 400\">rights supporters have developed an arsenal of legal tactics for confronting anti-abortion protesting, ranging from general trespassing laws to federal legislation specifically protecting clinic access.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This article provides an overview of abortion protesting, steps the federal government has taken to protect the rights and safety of patients and abortion providers, anti-abortion protesters\u2019 free speech rights, and the First Amendment debate surrounding abortion protest. Part II discusses federal legislative approaches upheld in abortion protesting cases, specifically the Freedom of\u00a0 Access to Clinic Entrances Act of 1994 and the constitutional challenges brought against the statute.
