Since the Federalists<\/span><\/span><span id=\"page3369R_mcid4\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">bat<\/span><span dir=\"ltr\" role=\"presentation\">tled<\/span><\/span><span id=\"page3369R_mcid8\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">the Anti-Federalists, our allegiances have been divided between two <\/span><span dir=\"ltr\" role=\"presentation\">vastly different forms of social organization. Community is built around <\/span><span dir=\"ltr\" role=\"presentation\">the close, complex relationships among small groups of people, such as <\/span><span dir=\"ltr\" role=\"presentation\">the members of a family, the residents of a small town, or the<\/span><\/span><span id=\"page3369R_mcid7\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">congre<\/span><span dir=\"ltr\" role=\"presentation\">gants<\/span><\/span><span id=\"page3369R_mcid12\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of a church. On the other hand, Society organizes limited<\/span><\/span><span id=\"page3369R_mcid11\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">interac<\/span><span dir=\"ltr\" role=\"presentation\">tions<\/span><\/span><span id=\"page3369R_mcid16\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">among relative strangers, pursuing efficiency or ideological ends. <\/span><span dir=\"ltr\" role=\"presentation\">Industrialization and urbanization ensured Society\u2019s dominance in<\/span><\/span><span id=\"page3369R_mcid15\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">eco<\/span><span dir=\"ltr\" role=\"presentation\">nomic<\/span><\/span><span id=\"page3369R_mcid18\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">life, politics, and law. Yet continued reverence for Community <\/span><span dir=\"ltr\" role=\"presentation\">ideals of connection and belonging keeps it a powerful force. <\/span><\/span><\/em><\/p>\n<p class=\"p2\"><em><span id=\"page3369R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Society\u2019s<\/span> <span dir=\"ltr\" role=\"presentation\">neglect<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">Community<\/span> <span dir=\"ltr\" role=\"presentation\">is<\/span> <span dir=\"ltr\" role=\"presentation\">deeply<\/span> <span dir=\"ltr\" role=\"presentation\">destabilizing.<\/span> <span dir=\"ltr\" role=\"presentation\">President <\/span><span dir=\"ltr\" role=\"presentation\">Trump\u2019s ability to speak to many voters\u2019 fear of Society obliterating <\/span><span dir=\"ltr\" role=\"presentation\">Community helped him triumph over establishment Republicans and <\/span><span dir=\"ltr\" role=\"presentation\">Democrats speaking the language of Society.<\/span><\/span><span id=\"page3369R_mcid20\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/em><\/p>\n<p class=\"p2\"><em><span id=\"page3369R_mcid20a\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">This affinity for Community has shaped numerous constitutional<\/span><\/span><span id=\"page3369R_mcid22\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">doc<\/span><span dir=\"ltr\" role=\"presentation\">trines.<\/span><\/span><span id=\"page3369R_mcid26\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Ideologically disparate Justices have united to protect key<\/span><\/span><span id=\"page3369R_mcid25\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">mani<\/span><span dir=\"ltr\" role=\"presentation\">festations<\/span><\/span><span id=\"page3369R_mcid28\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of Community such as small towns, schools, local police, and <\/span><span dir=\"ltr\" role=\"presentation\">juries. <\/span><\/span><\/em><\/p>\n<p class=\"p2\"><em><span id=\"page3369R_mcid29\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Ignoring Community has undermined constitutional litigation. It has <\/span><span dir=\"ltr\" role=\"presentation\">also led to the acceptance of dubious and inconsistent analogies between <\/span><span dir=\"ltr\" role=\"presentation\">different phenomena in Community and Society.
