I<\/span>NTRODUCTION<\/p>\n<p class=\"p3\">\u201c<i>There is no iron curtain drawn between the Constitution and the prisons of this country<\/i>.\u201d<\/p>\n<p class=\"p3\">\u2014<i>Wolff v. It is not easy work. And there\u2019s a ton of it. Each week, I get requests from incarcerated individuals who need representation for alleged fights, possession of contraband, and disagreements with guards. While many people who study or work in the criminal legal system might be familiar with punishments given out at sentencing, including the trial tax\n\t\t<span class='js-footnote footnote'>\n\t\t\t<button type='button' aria-controls='abstract_footnote_20892_2' class='footnote_inline_btn js-footnote-toggle-btn' aria-describedby='footnote_btn_text_abstract_footnote_20892_2'>\n\t\t\t\t<sup class='footnote_inline_btn_number'>2<\/sup>\n\t\t\t\t<span id='footnote_btn_text_abstract_footnote_20892_2' class='visually_hide'>Open footnote #2<\/span>\n\t\t\t<\/button>\n\t\n\t\t\t<cite id='abstract_footnote_20892_2' class='footnote_content_cite js-footnote-content'>\n\t\t\t\t<span class='footnote_content_wrap'>\n\t\t\t\t\t<button type='button' class='footnote_content_number js-footnote-toggle-btn' aria-controls='abstract_footnote_20892_2' tabindex='-1'>2<\/button>\n\t\n\t\t\t\t\t<span class='footnote_content_wrap_inner'>\n\t\t\t\t\t\t<span class='footnote_content'>\n\t\t\t\t\t\t\t<span class='visually_hide'>Footnote #2 content: <\/span>The \u201ctrial tax\u201d describes how defendants who plead guilty have been found to receive less severe punishments compared to those who are convicted following a trial. <i>See <\/i>Alexander Testa &amp; Brian D. The ramifications for getting in trouble once inside a maximum-security prison like Wende\u2014where there is already constant surveillance, restrictions, and lack of access to the outside world\u2014can mean many dark months, if not years.
