The use of direct democracy\u00a0for such purposes contravenes the structure, history, and\u00a0philosophical underpinnings of our Constitution. Moreover, it poses\u00a0structural and practical problems in civil rights litigation under the\u00a0Supreme Court\u2019s intent-based Equal Protection jurisprudence. This Note\u00a0argues that to ensure that voter might does not define minority rights at\u00a0the state level, the Supreme Court should adopt a categorical rule under\u00a0Washington v.
