This figure displays the reversal rates for the top ten issues raised on appeals in state courts. Only \u201c[r]elevancy\/prejudicial evidence\u201d at 2.9% ranked lower than \u201c[i]neffective assistance\u201d at 3.6%; however, the data for relevancy should be \u201c[i]nterpret[ed] with caution\u201d due to the statistical outcomes. <em>Id.<\/em> Therefore, it\u2019s possible that ineffective assistance of counsel is actually the least likely category of error to be reversed in state courts.\n\n\t\t\t\t\t\t<\/span>\n\t\n\t\t\t\t\t\t\n\t\n\t\t\t\t\t\t<span class='footnote_close_btn_wrap'>\n\t\t\t\t\t\t\t<button type='button' class='footnote_close_btn js-footnote-close-btn' aria-label='Back to content'>close<\/button>\n\t\t\t\t\t\t<\/span>\n\t\t\t\t\t<\/span>\n\t\t\t\t<\/span>\n\t\t\t<\/cite>\n\t\t<\/span>\n\t The difficulty of obtaining relief on ineffective-assistance-of-trial-counsel (IATC) claims is twofold. First, IATC claims are subject to a demanding standard of review. Under <\/em>Strickland v. Washington<em>, proving constitutionally ineffective assistance of counsel requires showing both that counsel\u2019s performance was deficient and that that deficient performance actually prejudiced the defendant.\n\t\t<span class='js-footnote footnote'>\n\t\t\t<button type='button' aria-controls='abstract_footnote_24094_4' class='footnote_inline_btn js-footnote-toggle-btn' aria-describedby='footnote_btn_text_abstract_footnote_24094_4'>\n\t\t\t\t<sup class='footnote_inline_btn_number'>4<\/sup>\n\t\t\t\t<span id='footnote_btn_text_abstract_footnote_24094_4' class='visually_hide'>Open footnote #4<\/span>\n\t\t\t<\/button>\n\t\n\t\t\t<cite id='abstract_footnote_24094_4' class='footnote_content_cite js-footnote-content'>\n\t\t\t\t<span class='footnote_content_wrap'>\n\t\t\t\t\t<button type='button' class='footnote_content_number js-footnote-toggle-btn' aria-controls='abstract_footnote_24094_4' <\/span>466 U.S. 668, 687 (1984).\n\n\t\t\t\t\t\t<\/span>\n\t\n\t\t\t\t\t\t\n\t\n\t\t\t\t\t\t<span class='footnote_close_btn_wrap'>\n\t\t\t\t\t\t\t<button type='button' class='footnote_close_btn js-footnote-close-btn' aria-label='Back to content'>close<\/button>\n\t\t\t\t\t\t<\/span>\n\t\t\t\t\t<\/span>\n\t\t\t\t<\/span>\n\t\t\t<\/cite>\n\t\t<\/span>\n\t However, \u201c[j]udicial scrutiny of counsel\u2019s performance must be highly deferential\u201d to eliminate concerns of hindsight bias and to account for the possibility that the purportedly deficient performance was actually strategic.\n\t\t<span class='js-footnote footnote'>\n\t\t\t<button type='button' aria-controls='abstract_footnote_24094_5' class='footnote_inline_btn js-footnote-toggle-btn' aria-describedby='footnote_btn_text_abstract_footnote_24094_5'>\n\t\t\t\t<sup class='footnote_inline_btn_number'>5<\/sup>\n\t\t\t\t<span id='footnote_btn_text_abstract_footnote_24094_5' js-footnote-close-btn' aria-label='Back to content'>close<\/button>\n\t\t\t\t\t\t<\/span>\n\t\t\t\t\t<\/span>\n\t\t\t\t<\/span>\n\t\t\t<\/cite>\n\t\t<\/span>\n\t Second, many states have procedural systems which discourage or even forbid raising these claims on appeal, requiring instead that they be brought in state postconviction proceedings.\n\t\t<span class='js-footnote footnote'>\n\t\t\t<button type='button' aria-controls='abstract_footnote_24094_6' class='footnote_inline_btn js-footnote-toggle-btn' aria-describedby='footnote_btn_text_abstract_footnote_24094_6'>\n\t\t\t\t<sup class='footnote_inline_btn_number'>6<\/sup>\n\t\t\t\t<span id='footnote_btn_text_abstract_footnote_24094_6' federal constitutional right to counsel,\n\t\t<span class='js-footnote footnote'>\n\t\t\t<button type='button' aria-controls='abstract_footnote_24094_7' class='footnote_inline_btn js-footnote-toggle-btn' aria-describedby='footnote_btn_text_abstract_footnote_24094_7'>\n\t\t\t\t<sup class='footnote_inline_btn_number'>7<\/sup>\n\t\t\t\t<span
