Regents of the University of California and its Implications"},"content":{"rendered":"<p><em>The Trump Administration\u2019s effort to get rid of the Obama Administration\u2019s\u00a0Deferred Action for Childhood Arrivals program, or DACA, failed before the\u00a0Supreme Court in <\/em>Department of Homeland Security v. Regents of the\u00a0University of California<em>. In this essay\u2014adapted from a presentation given to an American Bar Association\u00a0section in September 2020\u2014Brian Wolfman reviews DACA, the Supreme Court&#8217;s decision, and its administrative-law implications.\u00a0<\/em><\/p>\n<p><em>The failure of the Trump Administration to eliminate DACA may have had significant political consequences, and it surely had immediate and\u00a0momentous consequences for many of DACA\u2019s hundreds of thousands of\u00a0beneficiaries. In the aftermath of the Court\u2019s decision, some commentators\u00a0noted, however, that the Supreme Court\u2019s ruling it is not a major legal\u00a0landmark\u2014that it involves only the application of settled administrative-law\u00a0principles. Wolfman largely agrees. Nonetheless, the decision\u2019s\u00a0administrative-law holdings are interesting, and the Court\u2019s ruling contains\u00a0several of what Wolfman sees as \u201cextras\u201d\u2014little nuances that may affect\u00a0the law over time and that should interest administrative-law nerds.
