{"id":288,"date":"2019-01-31T10:09:00","date_gmt":"2019-01-31T15:09:00","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/icap\/?page_id=288"},"modified":"2025-05-12T11:15:30","modified_gmt":"2025-05-12T15:15:30","slug":"more-than-80-current-and-former-prosecutors-and-law-enforcement-leaders-call-for-bail-reform-in-legal-filing","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/icap\/our-press-releases\/more-than-80-current-and-former-prosecutors-and-law-enforcement-leaders-call-for-bail-reform-in-legal-filing\/","title":{"rendered":"More Than 80 Current and Former Prosecutors and Law Enforcement Leaders Call for Bail Reform in Legal Filing"},"content":{"rendered":"<p><strong>NEW ORLEANS, January 30, 2019 \u2014 <\/strong>A group of 82 criminal justice leaders \u2013 including current and former local, state and federal prosecutors and other law enforcement officials, former Department of Justice leaders, and former judges from 33 different states and the District of Columbia \u2013 filed an amicus curiae (\u201cfriend of the court\u201d) <a href=\"http:\/\/www.law.georgetown.edu\/icap\/wp-content\/uploads\/sites\/32\/2019\/01\/Daves-v.-Dallas-brief.pdf\">brief<\/a> today in <em>Daves v. Dallas County, <\/em>a case in the U.S. Court of Appeals for the Fifth Circuit challenging the constitutionality of cash bail. The brief supports the district court\u2019s decision that detaining poor people before trial based solely on their inability to pay pre-determined money bail in Dallas County, Texas, while those who are able to pay go free, violates equal protection and due process rights guaranteed by the U.S. Constitution.<\/p>\n<p>The amicus brief is the latest in a series of filings in cases across the country in which prosecutors and others responsible for public safety have weighed in against the use of cash bail. The brief was written by litigators at Georgetown Law\u2019s Institute for Constitutional Advocacy and Protection (ICAP) and was coordinated by Fair and Just Prosecution (FJP), a non-profit organization dedicated to promoting a justice system grounded in fairness, equity, compassion, and fiscal responsibility.<\/p>\n<p>\u201cCommon sense dictates that people should not be held in jail simply because they cannot afford a monetary payment. For too long our country has tolerated a two-tiered system of justice that imposes a \u2018poverty penalty\u2019 and incarcerates pretrial individuals who pose no danger to our community, simply because they cannot pay their way to freedom,\u201d said <strong>FJP Executive Director Miriam<\/strong> <strong>Krinsky<\/strong>. \u201cA cash bail system unnecessarily destabilizes individuals, families and communities and erodes trust that is integral to the effective functioning of our justice system.\u201d<\/p>\n<p>The group of signatories includes <strong>Attorneys General Thomas J. Donovan<\/strong> (Vermont), <strong>Brian E. Frosh<\/strong> (Maryland) and <strong>Karl Racine<\/strong> (District of Columbia); <strong>District Attorneys Mark Dupree<\/strong> (Kansas City, KS), <strong>Eric Gonzalez<\/strong> (Brooklyn), <strong>Lawrence S. Krasner<\/strong> (Philadelphia), and <strong>Kim Ogg<\/strong> (Houston); <strong>State\u2019s Attorneys Marilyn Mosby <\/strong>(Baltimore), <strong>Kimberly Foxx <\/strong>(Chicago), <strong>Sarah George<\/strong> (Burlington, VT); <strong>State Attorney<\/strong> <strong>Aramis Ayala<\/strong> (Orlando); <strong>Police Chiefs Chris Magnus<\/strong> (Tucson Police Department, AZ) and <strong>Abdul D. Pridgen<\/strong> (Seaside Police Department, CA); <strong>Sheriff Jerry Clayton<\/strong> (Washtenaw County, MI) and <strong>Commissioner Branville Bard<\/strong> (Cambridge Police Department, MA). They argue that wealth-based detention undermines confidence in the criminal justice system, impedes the work of prosecutors and law enforcement officials, fails to promote safe communities and costs taxpayers money.<\/p>\n<p>The group of signees includes:<\/p>\n<ul>\n<li><strong>36<\/strong> sitting elected prosecutors, including attorneys general, district attorneys, and state attorneys;<\/li>\n<li><strong>13<\/strong> current or former police chiefs or sheriffs;<\/li>\n<li><strong>16<\/strong> former attorneys general, district attorneys and U.S. Attorneys;<\/li>\n<li>former head of the Civil Rights Division at the U.S. Department of Justice <strong>Vanita Gupta<\/strong> and former acting U.S. Solicitor General <strong>Walter Dellinger<\/strong><\/li>\n<\/ul>\n<p>\u201cProsecutors and law enforcement officials understand that public safety depends on confidence in the integrity and legitimacy of the criminal justice system,\u201d said the brief\u2019s author, <strong>Mary<\/strong> <strong>McCord<\/strong>, a former federal prosecutor.\u00a0 \u201cDetaining people in jail before trial for days, weeks, even months, solely because they are too poor to afford money bail, exposes the unfairness of the system and drives a wedge between public safety officials and the communities they serve.\u201d<\/p>\n<p>In <em>Daves v. Dallas County<\/em>, the plaintiffs successfully argued that the county\u2019s practice of detaining individuals pretrial solely because they cannot afford to pay pre-determined amounts of money bail, with no inquiry into their ability to pay or whether their detention is necessary to ensure their appearance at future court hearings or to protect public safety, violates constitutional equal protection and due process rights. The amicus brief supports the district court\u2019s order enjoining this wealth-based detention system.<\/p>\n<p>\u201cThis brief reflects the growing recognition that the cash bail system is no longer acceptable,\u201d said <strong>District Attorney<\/strong> <strong>Rachael Rollins<\/strong>. \u201cIt leads to the unnecessary and unconstitutional detention of people who are indigent, deepens the cycle of poverty,\u00a0disparately impacts Black and Latinx communities\u00a0and eviscerates public trust in the justice system.
