United States on presidential immunity. Mary also joined Princeton&#8217;s Program in Public Law and Public Policy on a recent panel to discuss election hazards and potential solutions \u2013 find the full recording of the panel <a href=\"https:\/\/mediacentral.princeton.edu\/id\/1_avyd0jx2?width=608&amp;height=402&amp;playerId=25624581\">here<\/a>.<\/i><\/p>\n<p>ICAP and Law Forward successfully represented two Wisconsin electors in a landmark <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/penebaker-v-hitt\/\">lawsuit against the fraudulent electors and their co-conspirators<\/a> who sought to have their votes for Trump and Pence counted on January 6 instead of the votes of the legitimate presidential electors whose ballots represented the will of the Wisconsin voters. Our litigation resulted in a first-of-its-kind <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-press-releases\/lawyers-who-conceived-and-executed-the-2020-fake-elector-scheme-agree-not-to-participate-in-a-similar-scheme-in-any-future-presidential-election\/\">settlement<\/a> and the release of thousands of <strong>new documents<\/strong> that shed new light on the origins of the false elector scheme.<\/p>\n<p>ICAP represented the House Select Committee to Investigate the January 6th Attack on the United States Capitol in its defense against a <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/trump-v-thompson\/\">lawsuit<\/a> by former president Donald Trump seeking to enjoin the release of Presidential records from the National Archives containing <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/trump-v-thompson\/\">White House communications relating to the events on and leading up to January 6, 2021<\/a>. The Supreme Court ultimately <a href=\"https:\/\/www.law.georgetown.edu\/icap\/wp-content\/uploads\/sites\/32\/2022\/01\/Trump-v-Thompson-Supreme-Court-order.pdf\">allowed<\/a> for the release of these documents, which provided crucial evidence to the Select Committee&#8217;s investigation.<\/p>\n<p>ICAP also represented the House Judiciary Committee in its lawsuit to compel the <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/sticking-up-for-whistleblowers-transparency-and-the-special-counsel\/house-judiciary-committee-v-mcgahn\/\">former White House Counsel<\/a> to testify on matters and information discussed in the Special Counsel\u2019s Report and in its suit for access to <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/sticking-up-for-whistleblowers-transparency-and-the-special-counsel\/in-re-application-of-the-house-judiciary-committee-for-an-order-authorizing-release-of-certain-grand-jury-materials\/\">grand jury materials<\/a> redacted from the Mueller report. In addition, ICAP sought information under FOIA on <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/icap-v-u-s-citizenship-and-immigration-services\/\">how USCIS implemented a since-rescinded public charge rule<\/a> that gave it expansive authority to deny noncitizens admission to the United States, information under the Maryland Public Information Act to to shed light on the <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/icap-v-baltimore-police-department\/\">Baltimore Police Department\u2019s compliance with legally mandated transparency practices<\/a>, and represents plaintiffs in a lawsuit seeking information under FOIA to <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/sticking-up-for-whistleblowers-transparency-and-the-special-counsel\/texas-civil-rights-project-v-customs-and-border-protection\/\">uncover details regarding the expulsion of unaccompanied and undocumented children<\/a> without legal process since the beginning of the COVID-19 epidemic.<\/p>\n<p>ICAP has also written op-eds, filed amicus briefs, and gathered important voices challenging the Executive Branch to push for public disclosure of important documents, to protect government whistleblowers, and to ensure accuracy in government reporting.<\/p>\n<p><strong>ICAP has produced <span class=\"il\">guidance<\/span> for fostering First Amendment rights in a variety of circumstances, including related to elections, polling places, and public protests and demonstrations.<\/strong><\/p>\n<ul>\n<li><a href=\"https:\/\/www.law.georgetown.edu\/icap\/wp-content\/uploads\/sites\/32\/2022\/09\/Constitutional-Sheriffs-Fact-Sheet.pdf\">&#8220;Constitutional Sheriffs&#8221; and Elections<\/a><\/li>\n<li><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/guidance-related-to-elections-and-polling-places\/\">Guidance Related to Elections and Polling Places<\/a><\/li>\n<li><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/guidance-related-to-public-protests-and-demonstrations\/\">Guidance Related to Public Protests and Demonstrations<\/a><\/li>\n<li><a href=\"https:\/\/www.law.georgetown.edu\/icap\/wp-content\/uploads\/sites\/32\/2022\/04\/2022.4.7.-Countering-Bigotry-and-Extremism-in-the-Ranks.pdf\">Countering Bigotry and Extremism in the Ranks: A First Amendment Guide for Law Enforcement Agencies<\/a><\/li>\n<\/ul>\n<h2>Our Work<\/h2>\n<ul>\n<li><span style=\"font-weight: 400\">3\/24\/26 \u2013 Filed a <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/wp-content\/uploads\/sites\/32\/2026\/03\/MN-v-DOJ-Complaint.pdf\"><span style=\"font-weight: 400\"><strong>complaint<\/strong><\/span><\/a><span style=\"font-weight: 400\"> in\u00a0<em><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/promoting-good-government-voting-rights-whistleblowers-and-transparency\/state-of-minnesota-v-u-s-department-of-justice\/\">State of Minnesota v.
