{"id":302,"date":"2019-03-13T15:43:58","date_gmt":"2019-03-13T19:43:55","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/icap\/?page_id=302"},"modified":"2026-03-26T15:48:37","modified_gmt":"2026-03-26T19:48:37","slug":"defending-immigrants-and-sanctuary-cities","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/","title":{"rendered":"Defending the Rights of Immigrants and Those Who Support Them"},"content":{"rendered":"<p><span style=\"font-weight: 400\">ICAP has<\/span> <span style=\"font-weight: 400\">represented organizations in <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/mennonite-church-usa-v-u-s-department-of-homeland-security\/\"><span style=\"font-weight: 400\">challenging the Department of Homeland Security\u2019s new policy<\/span><\/a><span style=\"font-weight: 400\"> authorizing\u00a0 federal immigration enforcement in places of worship and other &#8220;sensitive locations&#8221;; an <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/casa-v-trump-2025\/\"><span style=\"font-weight: 400\">Executive Order purporting to deny birthright citizenship<\/span><\/a><span style=\"font-weight: 400\"> to certain immigrant children, in violation of the Citizenship Clause of the Fourteenth Amendment; and a <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/catholic-charities-of-the-rio-grande-valley\/\"><span style=\"font-weight: 400\">baseless investigation by the Texas Attorney General<\/span><\/a><span style=\"font-weight: 400\"> into services a religious organization provides to immigrants. Additionally, ICAP has <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/state-ex-rel-rokita-v-monroe-county-sheriffs-office\/\"><span style=\"font-weight: 400\">defended an Indiana Sheriff<\/span><\/a><span style=\"font-weight: 400\"> against a lawsuit by the Indiana Attorney General challenging the Sheriff\u2019s immigration policy, which limits local law enforcement\u2019s involvement with federal immigration enforcement.<\/span><\/p>\n<p><span style=\"font-weight: 400\">We served as co-counsel in helping plaintiffs challenge <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/standing-up-for-immigrant-communities-sanctuary-cities-and-daca\/casa-v-trump\/\"><span style=\"font-weight: 400\">a Department of Homeland Security rule that harms immigrants<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-vulnerable-communities-sanctuary-cities-daca-and-more\/e-b-v-pompeo\/\"><span style=\"font-weight: 400\">a new State Department Diversity Visa Program rule<\/span><\/a><span style=\"font-weight: 400\">, and <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-vulnerable-communities-sanctuary-cities-daca-and-more\/r-v-v-mnuchin\/\"><span style=\"font-weight: 400\">the intentional and discriminatory exclusion of U.S. citizen children<\/span><\/a><span style=\"font-weight: 400\"> from the benefits of emergency cash assistance distributed in response to the coronavirus pandemic. We also served as co-counsel to the cities of <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/standing-up-for-immigrant-communities-sanctuary-cities-and-daca\/nicholson-v-city-of-gary-indiana-serbon-v-city-of-east-chicago\/\"><span style=\"font-weight: 400\">Gary and East Chicago, Indiana<\/span><\/a><span style=\"font-weight: 400\">, to successfully defend their \u201cwelcoming city\u201d ordinances from a lawsuit characterized by its architects as the first salvo in a potentially nationwide effort to roll back so-called \u201csanctuary city\u201d or \u201cwelcoming city\u201d policies, and served as co-counsel <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/standing-up-for-immigrant-communities-sanctuary-cities-and-daca\/city-of-el-cenizo-v-texas\/\"><span style=\"font-weight: 400\">challenging Texas\u2019s anti-sanctuary city statute, \u201cSB4,\u201d<\/span><\/a><span style=\"font-weight: 400\"> with a focus on the First Amendment concerns raised by the statute.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In addition, we served as lead counsel <\/span><a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/standing-up-for-immigrant-communities-sanctuary-cities-and-daca\/schreiber-v-cissna\/\"><span style=\"font-weight: 400\">representing a military veteran seeking to keep his lawfully adopted daughter<\/span><\/a><span style=\"font-weight: 400\"> in the United States.<\/span><\/p>\n<h2>Our Work<\/h2>\n<ul>\n<li>3\/24\/26 \u2013 Presented <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/audio\/2025\/25-5\">oral argument<\/a> in <a href=\"https:\/\/www.law.georgetown.edu\/icap\/our-work\/defending-immigrants-and-sanctuary-cities\/noem-v-al-otro-lado\/\"><em>Noem v.
