Questions have <\/span><span dir=\"ltr\" role=\"presentation\">recently been raised, however, about the status of the Convention in U.S. law<\/span> <span dir=\"ltr\" role=\"presentation\">\u2013<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">in particular, whether it can properly be considered directly applicable in state <\/span><span dir=\"ltr\" role=\"presentation\">courts (as a<\/span> <span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">self-executing<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span> <span dir=\"ltr\" role=\"presentation\">treaty) notwithstanding its legislative<\/span><\/span><span class=\"markedContent\"><span class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">implementa<\/span><span dir=\"ltr\" role=\"presentation\">tion<\/span><\/span><\/span><span class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">through the Federal Arbitration Act. This article considers (i) whether a <\/span><span dir=\"ltr\" role=\"presentation\">duly-ratified treaty can simultaneously be directly applicable and legislatively <\/span><span dir=\"ltr\" role=\"presentation\">implemented, (ii) whether a U.S. court could, in the context of a specific<\/span><\/span><span class=\"markedContent\"><span class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">pro<\/span><span dir=\"ltr\" role=\"presentation\">ceeding<\/span><\/span><\/span><span class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">involving private parties, override the decision of the constitutionally <\/span><span dir=\"ltr\" role=\"presentation\">empowered<\/span> <span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">treaty makers<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span> <span dir=\"ltr\" role=\"presentation\">regarding the treaty\u2019s implementation, and (iii) <\/span><span dir=\"ltr\" role=\"presentation\">whether such a decision could give the federal government greater authority to <\/span><span dir=\"ltr\" role=\"presentation\">compel compliance by state courts than the implementing statute.
