{"id":1462,"date":"2023-02-13T10:42:12","date_gmt":"2023-02-13T15:42:12","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/international-law-journal\/?page_id=1462"},"modified":"2025-12-19T13:13:42","modified_gmt":"2025-12-19T18:13:42","slug":"hope-for-accountability-the-hybrid-court-of-south-sudan","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/international-law-journal\/in-print\/volume-53\/volume-53-number-2-winter-2022\/hope-for-accountability-the-hybrid-court-of-south-sudan\/","title":{"rendered":"Hope for Accountability: The Hybrid Court of South Sudan"},"content":{"rendered":"<p><span id=\"page1297R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In January of 2021, the government of South Sudan indicated its intent to <\/span><span dir=\"ltr\" role=\"presentation\">establish a hybrid war crimes tribunal, the Hybrid Court of South Sudan <\/span><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">HCSS<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span><span dir=\"ltr\" role=\"presentation\">), to prosecute human rights violations that occurred during the civil <\/span><span dir=\"ltr\" role=\"presentation\">war that began in 2013. With this announcement came a renewed hope of<\/span><\/span><span class=\"markedContent\"><span id=\"page1297R_mcid23\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">jus<\/span><span dir=\"ltr\" role=\"presentation\">tice,<\/span><\/span><\/span><span id=\"page1297R_mcid25\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">accountability, and peace for the South Sudanese people. However, given <\/span><span dir=\"ltr\" role=\"presentation\">the government\u2019s previous hostility toward the HCSS, prior efforts to delay its <\/span><span dir=\"ltr\" role=\"presentation\">establishment, and the fact that it may well be implicated in many of the <\/span><span dir=\"ltr\" role=\"presentation\">Court\u2019s investigations and cases, there is also a justifiable skepticism<\/span><\/span><span class=\"markedContent\"><span id=\"page1297R_mcid27\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">surround<\/span><span dir=\"ltr\" role=\"presentation\">ing<\/span><\/span><\/span><span id=\"page1297R_mcid29\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">the creation of the Court. Indeed, establishing and operationalizing the <\/span><span dir=\"ltr\" role=\"presentation\">HCSS is sure to present immense challenges, including the government\u2019s lack of <\/span><span dir=\"ltr\" role=\"presentation\">political will to prosecute, difficulties surrounding victim participation and <\/span><span dir=\"ltr\" role=\"presentation\">protection, and funding. However, this Note argues that it is precisely because <\/span><span dir=\"ltr\" role=\"presentation\">of these challenges that a hybrid court is the mechanism most suited to this<\/span><\/span><span class=\"markedContent\"><span id=\"page1297R_mcid31\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">cir<\/span><span dir=\"ltr\" role=\"presentation\">cumstance,<\/span><\/span><\/span><span id=\"page1297R_mcid33\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and that the HCSS is South Sudan\u2019s best hope for achieving justice <\/span><span dir=\"ltr\" role=\"presentation\">and accountability. This Note examines the many advantages of the hybrid <\/span><span dir=\"ltr\" role=\"presentation\">court paradigm, including its flexibility, increased legitimacy, capacity<\/span><\/span><span class=\"markedContent\"><span id=\"page1297R_mcid35\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">build<\/span><span dir=\"ltr\" role=\"presentation\">ing,<\/span><\/span><\/span><span id=\"page1297R_mcid36\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and norm diffusion, and analyzes how these benefits could be leveraged in <\/span><span dir=\"ltr\" role=\"presentation\">the South Sudanese context.
