{"id":8246,"date":"2025-09-08T14:10:51","date_gmt":"2025-09-08T14:10:03","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/tech-institute\/insights\/tech-brief-airplane-response-2\/"},"modified":"2025-11-04T18:16:30","modified_gmt":"2025-11-04T18:16:30","slug":"tech-brief-airplane-response-2","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/tech-institute\/research-insights\/insights\/tech-brief-airplane-response-2\/","title":{"rendered":"Tech Brief: Airplane Response"},"content":{"rendered":"<p>September 8, 2025<\/p>\n<p style=\"text-align: center\"><span style=\"font-weight: 400\">***<\/span><\/p>\n<p><span style=\"font-weight: 400\">Last week, Delta <\/span><a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2025\/08\/Delta-Gallego-Response-Letter-07.31.25.pdf\"><span style=\"font-weight: 400\">told lawmakers<\/span><\/a><span style=\"font-weight: 400\">: <\/span><i><span style=\"font-weight: 400\">&#8220;There is no fare product Delta has ever used, is testing or plans to use that targets customers with individualized prices based on personal data. . . . [O]ur ticket pricing never takes into account personal data. . . . [C]ustomers are not required to sign in on delta.com or the app to shop and compare prices.\u201d<\/span><\/i><\/p>\n<p><b>What\u2019s going on? <\/b><span style=\"font-weight: 400\">In December 2023, Delta President Glen Hauenstein <\/span><a href=\"https:\/\/www.reuters.com\/business\/delta-air-assures-us-lawmakers-it-will-not-personalize-fares-using-ai-2025-08-01\/\"><span style=\"font-weight: 400\">told investors<\/span><\/a><span style=\"font-weight: 400\"> that the carrier&#8217;s AI price-setting technology is capable of setting fares based on a prediction of \u201cthe amount people are willing to pay for the premium products related to the base fares.\u201d Delta said that \u201cby the end of [2025] it wants to use AI to set 20% of all fares,\u201d according to an <\/span><a href=\"https:\/\/www.npr.org\/2025\/07\/24\/nx-s1-5476735\/artificial-intelligence-setting-all-airfares-that-future-might-not-be-far-off\"><span style=\"font-weight: 400\">NPR report<\/span><\/a><span style=\"font-weight: 400\">. <\/span><span style=\"font-weight: 400\">During an investor day last year, Hauenstein further described Delta\u2019s algorithmic pricing capability: <\/span><span style=\"font-weight: 400\">\u201cWe will have a price that\u2019s available on that flight, on that time, to you, the individual.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Fetcherr is the AI pricing company that partners with Delta Airlines \u2013 along with other airlines including Azul, Royal Air Maroc, Virgin Atlantic, Viva Aerobus, and WestJet. \u201cWe\u2019ve been training our engine, using all the data we can get our hands on,\u201d Roy Cohen, Fetcherr\u2019s CEO <\/span><a href=\"https:\/\/www.forbes.com\/sites\/tedreed\/2024\/08\/21\/airline-pricing-systems-are-ancient-heres-how-ai-can-help\/\"><span style=\"font-weight: 400\">said<\/span><\/a><span style=\"font-weight: 400\">. <\/span><span style=\"font-weight: 400\">Fetcherr also described individualized pricing as using \u201c<\/span><span style=\"font-weight: 400\">factors like customer lifetime value, past purchase behaviors, and the real-time context of each booking inquiry,\u201d which \u201call contribute to creating a truly personalized offer.\u201d The <\/span><a href=\"https:\/\/www.fetcherr.io\/blog\/dynamic-pricing-in-aviation\"><span style=\"font-weight: 400\">blog post<\/span><\/a><span style=\"font-weight: 400\"> from last December that contained that disclosure has <\/span><a href=\"https:\/\/web.archive.org\/web\/20250117202036\/https:\/\/www.fetcherr.io\/blog\/dynamic-pricing-in-aviation\"><span style=\"font-weight: 400\">since been scrubbed<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Senators sent a letter to Delta pressing for details, and Delta <\/span><a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2025\/08\/Delta-Gallego-Response-Letter-07.31.25.pdf\"><span style=\"font-weight: 400\">responded<\/span><\/a><span style=\"font-weight: 400\"> with a letter claiming that it doesn\u2019t use \u201cpersonal data\u201d in setting individualized prices \u2013 but it also hasn\u2019t said what data it <\/span><i><span style=\"font-weight: 400\">does<\/span><\/i><span style=\"font-weight: 400\"> use or the extent to which pricing may differ across individual customers.<\/span><\/p>\n<p><b>So does Delta use personal data?<\/b><span style=\"font-weight: 400\"> It is not clear what Delta means by \u201cpersonal data.\u201d Companies often try to define this term narrowly \u2013 limited to obvious identifiers like names, email addresses, and phone numbers. This of course would exclude behavioral data, device fingerprinting, or other less direct identifiers \u2013 like <\/span><a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2025\/08\/Delta-Gallego-Response-Letter-07.31.25.pdf\"><span style=\"font-weight: 400\">purchasing activity<\/span><\/a><span style=\"font-weight: 400\"> or perhaps frequent flyer numbers. An airline that denies using \u201cpersonal data\u201d might still rely on information and inferences that are functionally personal to shape offers and prices to a person. <\/span><span style=\"font-weight: 400\">It\u2019s the difference between saying \u201cPope Leo\u201d (personal information), and saying \u201cthe man who currently lives at the Vatican and is the head of the Catholic church\u201d (which a company may claim does not contain personal information, but is \u2026 obviously Pope Leo).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Moreover, even if an airline relies on data that truly isn\u2019t personal to either generate or apply its pricing models, the result might still be pricing that\u2019s personal. Suppose that an airline develops a model that takes into account information like time, approximate location, web browser, device manufacturer, or other attributes that are correlated with price sensitivity but not readily linkable to a person or device. Or, alternatively, suppose that the airline uses \u201c<\/span><a href=\"https:\/\/www.ftc.gov\/policy\/advocacy-research\/tech-at-ftc\/2024\/02\/keeping-your-privacy-enhancing-technology-pet-promises\"><span style=\"font-weight: 400\">privacy enhancing technology<\/span><\/a><span style=\"font-weight: 400\">\u201d (like differential privacy) to build a model based on correlations between customer attributes and price sensitivity without considering personal information. In the end, the price that one person receives may still be different from the price that another receives.<\/span><\/p>\n<p><b>And do consumers need to sign in for a company to collect data about you? <\/b><span style=\"font-weight: 400\">No. Not signing in doesn\u2019t mean you&#8217;re not being tracked. Companies <\/span><a href=\"https:\/\/www.levernews.com\/are-corporations-spying-on-you-to-raise-your-prices\/\"><span style=\"font-weight: 400\">still collect data<\/span><\/a><span style=\"font-weight: 400\"> about consumers \u2014 like your location, device type, browsing patterns, or <\/span><a href=\"https:\/\/www.aclu.org\/news\/privacy-technology\/facebook-tracking-me-even-though-im-not-facebook\"><span style=\"font-weight: 400\">other detailed profile data<\/span><\/a><span style=\"font-weight: 400\"> \u2014 <\/span><a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/reports\/cross-device-tracking-federal-trade-commission-staff-report-january-2017\/ftc_cross-device_tracking_report_1-23-17.pdf\"><span style=\"font-weight: 400\">without being logged into a service<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><b>Airlines have recently deployed the technical ability to determine offers and prices based on <\/b><b><i>who<\/i><\/b><b> a customer is, not just when or where they search. <\/b><span style=\"font-weight: 400\">When booking directly, the airline has the ability to provide customized offers in the same manner as any other retailer.\u00a0 But airline tickets are frequently searched for (and sometimes sold by) third-party online travel services such as Expedia or Google Flights.\u00a0 Using the <\/span><a href=\"https:\/\/www.iata.org\/en\/about\/\"><span style=\"font-weight: 400\">International Air Transport Association<\/span><\/a><span style=\"font-weight: 400\">\u2019s (IATA) <\/span><a href=\"https:\/\/www.iata.org\/en\/programs\/airline-distribution\/retailing\/ndc\/\"><span style=\"font-weight: 400\">New Distribution Capability<\/span><\/a><span style=\"font-weight: 400\"> (NDC) standard protocol, which has been in development since 2012 and is now being widely implemented, these third-party services can receive customized offers from airlines in response to a booking request. NDC requests can include data like the prospective traveler\u2019s frequent flyer number, which can be used by the airline to customize the set of flights offered and their prices. While a frequent flyer number does not contain a person\u2019s name or other more obvious identifiers, it is still personal data that can be and is tied to one individual.*<\/span><span style=\"font-weight: 400\"> This can be used to create \u201c<\/span><a href=\"https:\/\/developer.sabre.com\/ndc\/help?page=shopping-using-bargain-finder-max-api\"><span style=\"font-weight: 400\">personalized offers<\/span><\/a><span style=\"font-weight: 400\">\u201d\u00a0 that are shown to an individual in response to searches in real time.\u00a0<\/span><\/p>\n<p><b>Delta\u2019s letter raises more questions than answers. <\/b><span style=\"font-weight: 400\">Companies vary widely in their use of data and algorithms to determine prices. Yet, public information about these practices remains sparse. The FTC published a <\/span><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/01\/ftc-surveillance-pricing-study-indicates-wide-range-personal-data-used-set-individualized-consumer\"><span style=\"font-weight: 400\">Study<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.regulations.gov\/docket\/FTC-2025-0007\"><span style=\"font-weight: 400\">Request for Information<\/span><\/a><span style=\"font-weight: 400\"> about \u201csurveillance pricing\u201d in January 2025, and <\/span><a href=\"https:\/\/www.regulations.gov\/document\/FTC-2025-0007-0001\/comment\"><span style=\"font-weight: 400\">received comments from consumers<\/span><\/a><span style=\"font-weight: 400\"> about airline ticket prices like <\/span><a href=\"https:\/\/www.regulations.gov\/comment\/FTC-2025-0007-0023\"><span style=\"font-weight: 400\">this<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.regulations.gov\/comment\/FTC-2025-0007-0020\"><span style=\"font-weight: 400\">this one<\/span><\/a><span style=\"font-weight: 400\">. However, <\/span><a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/khan-statement-regarding-request-for-public-comment-re-surveillance-pricing-practices.pdf\"><span style=\"font-weight: 400\">the RFI was closed<\/span><\/a><span style=\"font-weight: 400\"> without explanation. To better understand how individualized pricing is applied, we outline open questions for <\/span><a href=\"https:\/\/www.travelweekly.com\/Travel-News\/Government\/Sean-Duffy-warns-airlines-price-discrimination\"><span style=\"font-weight: 400\">further investigation<\/span><\/a><span style=\"font-weight: 400\">:<\/span><\/p>\n<ol>\n<li><b>Where are people being charged AI-driven individualized prices<\/b><b>?** <\/b><span style=\"font-weight: 400\">Which industries and companies use and implement individualized pricing or AI-driven pricing? Current reporting indicates that at a minimum, groceries, retail, healthcare, banking, insurance, higher education, utilities, gig work platforms are using these models.<\/span><\/li>\n<li><b>Which <\/b><a href=\"https:\/\/www.cbsnews.com\/news\/top-airlines-us-the-points-guy\/\"><b>U.S. airlines<\/b><\/a><b> use AI\u2011powered or individualized pricing systems to raise costs, and what do they use?<\/b><span style=\"font-weight: 400\"> Which third-party technology providers or intermediaries (e.g., Fetcherr, PROS, etc.) do these airlines use to generate or optimize pricing for individual consumers or defined consumer segments?<\/span><\/li>\n<li><b>How does Delta define \u201cpersonal data\u201d in pricing? <\/b><span style=\"font-weight: 400\">How does Delta define \u201cpersonal data\u201d in the context of its AI pricing system? Specifically, what categories of data\u2014such as IP address, loyalty or frequent flyer status, device type, search history, or geolocation\u2014are used as inputs by the AI, for purposes like predicting ability to pay and generating prices?\u00a0<\/span><\/li>\n<li><b>What data and external sources feed airline pricing models? <\/b><span style=\"font-weight: 400\">Do airlines use AI pricing systems that rely on data from competitors for training? If so, how? Does Delta use other third-party providers or intermediaries (such as Fetcherr) for pricing, and what specific roles do they play? Do these consultants use data to infer someone\u2019s willingness to pay? What data? In what ways does customer loyalty influence individualized prices? Does Delta\u2019s AI pricing system incorporate customer loyalty program statuses or frequent flyer data when generating pricing recommendations?<\/span><\/li>\n<li><b>What are the AI pricing models designed to optimize? <\/b><span style=\"font-weight: 400\">Revenue per customer over time? Revenue per flight? Will an AI pricing model ever result in lower prices for a consumer? How are the AI prices performing on different audiences? What kind of person is being charged the most for a ticket? How have these models been tested to understand how they affect different kinds of consumers?<\/span><\/li>\n<li><b>Does Delta operate (or do its third-party providers enable) individual pricing at scale? <\/b><span style=\"font-weight: 400\">In Fetcherr\u2019s explanatory blog post, they describe the future of dynamic pricing as \u201cmoving from \u2018segments of thousands\u2019 to \u2018segments of one\u2019 \u2013 but at a scale that covers your entire network.\u201d Does Delta\u2019s AI pricing system generate or adjust fares for an individual consumer\u2019s transaction, even when relying on aggregated or group segmentation data?
