{"id":8345,"date":"2025-09-25T17:52:51","date_gmt":"2025-09-25T17:52:09","guid":{"rendered":"https:\/\/www.law.georgetown.edu\/tech-institute\/insights\/ai-sycophancy-impacts-harms-questions-2\/"},"modified":"2025-11-04T18:09:39","modified_gmt":"2025-11-04T18:09:39","slug":"ai-companions-harms-to-children","status":"publish","type":"page","link":"https:\/\/www.law.georgetown.edu\/tech-institute\/research-insights\/insights\/ai-companions-harms-to-children\/","title":{"rendered":"AI Companions &amp; Harms to Children"},"content":{"rendered":"<p>September 25, 2025<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">In August, <\/span><a href=\"https:\/\/www.reuters.com\/investigates\/special-report\/meta-ai-chatbot-guidelines\/\"><span style=\"font-weight: 400\">Reuters uncovered<\/span><\/a><span style=\"font-weight: 400\"> an internal Meta policy document, establishing governing standards that showed that Meta\u2019s chatbots were allowed to engage in \u201cromantic or sensual\u201d conversations with minors. Further, <\/span><a href=\"https:\/\/www.washingtonpost.com\/investigations\/2025\/09\/08\/meta-research-child-safety-virtual-reality\/\"><span style=\"font-weight: 400\">the Washington Post reported<\/span><\/a><span style=\"font-weight: 400\"> that \u201cMeta suppressed research\u201d that \u201cmight have illuminated potential safety risks to children and teens on the company\u2019s virtual reality devices and apps.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Since then, there has been high engagement on the topic from enforcers and policymakers. Senator Josh Hawley (R-MO) <\/span><a href=\"https:\/\/www.cnbc.com\/2025\/08\/15\/meta-ai-bot-child-investigation.html\"><span style=\"font-weight: 400\">launched<\/span><\/a><span style=\"font-weight: 400\"> an investigation, <\/span><a href=\"https:\/\/www.hawley.senate.gov\/kids-deserve-protection-hawley-launches-investigation-into-meta-for-training-its-ai-chatbots-to-target-children-with-sensual-conversation\/\"><span style=\"font-weight: 400\">demanding document productions<\/span><\/a><span style=\"font-weight: 400\"> from Meta following the report. A bipartisan group of 44 State Attorneys General <\/span><a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/AI%20Chatbot_FINAL%20%2844%29.pdf\"><span style=\"font-weight: 400\">wrote a letter<\/span><\/a><span style=\"font-weight: 400\"> to tech companies (including Meta, Google, Apple, Microsoft, OpenAI, and Anthropic) warning they would be held accountable for their decisions on child safety. The Federal Trade Commission issued a <\/span><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/09\/ftc-launches-inquiry-ai-chatbots-acting-companions\"><span style=\"font-weight: 400\">study inquiry<\/span><\/a><span style=\"font-weight: 400\"> into AI chatbots acting as companions. And Attorneys General from California and Delaware <\/span><a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/2025-09-05%20-%20Letter%20from%20DE%20AG%20and%20CA%20AG%20-%20FINAL%20with%20NAAG%20Letter.pdf\"><span style=\"font-weight: 400\">sent a joint letter,<\/span><\/a><span style=\"font-weight: 400\"> putting OpenAI \u201c<\/span><a href=\"https:\/\/sfstandard.com\/2025\/09\/05\/openai-chatgpt-safety-concerns-state-ags\/\"><span style=\"font-weight: 400\">on notice<\/span><\/a><span style=\"font-weight: 400\">\u201d about serious concerns with ChatGPT\u2019s safety.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Given the quickly moving developments, below is a high level list of interventions that lawmakers and enforcers might consider in the context of legislation or enforcement actions.\u00a0<\/span><span style=\"font-weight: 400\"><br \/>\n<\/span><\/p>\n<ol>\n<li><b>Ban on AI chatbots: <\/b><span style=\"font-weight: 400\">Prohibiting the deployment of AI chatbots for children.<\/span><\/li>\n<li><b>Duty of care: <\/b><span style=\"font-weight: 400\">Imposing on AI developers a duty of care in the design, deployment, and monitoring of AI systems for minors, analogous to obligations under the <\/span><a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/1748\/text\"><span style=\"font-weight: 400\">Kids Online Safety Act<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/li>\n<li><b>Ban on data collection for AI training: <\/b><span style=\"font-weight: 400\">Banning the monetization of data collected from minors, including for AI training<\/span><b>.<\/b><\/li>\n<li><b>Mandated assessments: <\/b><span style=\"font-weight: 400\">Requiring regular, formal impact assessments on child safety that are shared with independent auditors and government overseers.\u00a0<\/span><\/li>\n<li><b>Whistleblower protections: <\/b><span style=\"font-weight: 400\">Providing whistleblower protections for employees or contractors who raise concerns about child safety in AI systems.\u00a0<\/span><\/li>\n<li><b>Researcher Access &amp; Evaluation: <\/b><span style=\"font-weight: 400\">Requiring controlled API access to researchers, ensuring oversight, and enabling independent evaluation of child safety risks. We note that key safeguards will be needed to ensure this intervention provides real value to researchers and the public without opening the door to privacy abuses.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\"><span style=\"font-weight: 400\">***<\/span><\/p>\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/www.law.georgetown.edu\/tech-institute\/people\/our-team\/stephanie-nguyen\/\">Stephanie T.
