Musk also went on to state that, in the future, the bot will also be able to analyze legal documents. These claims may put Twitter at risk of violating laws against the unlicensed practice of medicine, as well as the unlicensed practice of law.\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400\"><strong>Bottom Line:<\/strong> Elon Musk\u2019s push to commercialize Twitter\u2019s \u201cGrok\u201d AI model and salvage the platform\u2019s profitability is taking him headlong into uncharted legal territory, with potentially serious consequences.\u00a0<\/span><\/i><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Elon Musk Promotes \u201cGrok\u201d AI Model as Bein<\/b><b>g<\/b><b> Capable of Anal<\/b><b>y<\/b><b>zin<\/b><b>g<\/b><b> Medical Data<\/b><b>,<\/b><b> Le<\/b><b>g<\/b><b>al Documents<\/b><\/h2>\n<p><b>On October 29, Elon Musk <\/b><a href=\"https:\/\/x.com\/elonmusk\/status\/1851206080564773344\"><b>made a post on Twitter<\/b> <\/a><b>in which he advertised his company\u2019s AI chatbot \u201cGrok\u201d as being capable of reading PET, MRI, and x-ray scans, as well as other medical information:<\/b><\/p>\n<blockquote><p><span style=\"font-weight: 400\">\u201cTry submitting x-ray, PET, MRI or other medical images to Grok for analysis. This is still early stage <\/span><span style=\"font-weight: 400\">[sic], but it is already quite accurate and will become extremely good. Let us know where Grok gets it right or needs work.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400\">When asked if the bot could also <\/span><a href=\"http:\/\/x.com\/Chesschick01\/status\/1851206602994696464\"><span style=\"font-weight: 400\">anal<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">ze blood sample results<\/span><\/a><span style=\"font-weight: 400\">, Musk <\/span><a href=\"http:\/\/x.com\/elonmusk\/status\/1851212037889892474\"><span style=\"font-weight: 400\">stated that it could.<\/span><\/a><span style=\"font-weight: 400\"> and also said that the ability to <\/span><a href=\"http:\/\/twitter.com\/CitiZenSleuthX\/status\/1851206875385057447\"><span style=\"font-weight: 400\">read and anal<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">ze le<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">al documents<\/span> <\/a><span style=\"font-weight: 400\">was <\/span><a href=\"http:\/\/elonmusk\/status\/1851208826009403419\"><span style=\"font-weight: 400\">forthcomin<\/span><span style=\"font-weight: 400\">g<\/span><\/a><span style=\"font-weight: 400\">. At the time of this writing, Musk\u2019s post has received at least 41 million views, and the replies seem to suggest that many users did, in fact, submit medical information to Grok for analysis, despite a lack of transparency on how this data might be used.<\/span><\/p>\n<h3><b>Possible Unlicensed Practice of Medicine<\/b><\/h3>\n<p><span style=\"font-weight: 400\">At present, Twitter is in the process of relocating from its former San Francisco, CA headquarters to Austin, TX. <\/span><b>Under Texas law, it is likely that Grok is engaging in the provision of medical advice, and is thus unlawfully practicing medicine without a license.<\/b><span style=\"font-weight: 400\"> The practice of medicine is defined by Texas law as: <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/docs\/OC\/htm\/OC.151.htm#:~:text=(13)%20%20%22Practicing%20medicine,for%20those%20services.\"><span style=\"font-weight: 400\">\u201cthe dia<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">nosis<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> treatment<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> or offer to treat a mental or ph<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">sical disease or disorder or a ph<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">sical deformit<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> or in<\/span><span style=\"font-weight: 400\">j<\/span><span style=\"font-weight: 400\">ur<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> b<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> an<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> s<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">stem or method<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> or the attempt to effect cures of those conditions<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> b<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> a person who:<\/span><\/a><\/p>\n<ol>\n<li><a href=\"https:\/\/statutes.capitol.texas.gov\/docs\/OC\/htm\/OC.151.htm#:~:text=(13)%20%20%22Practicing%20medicine,for%20those%20services.\"><span style=\"font-weight: 400\">publicl<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> professes to be a ph<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">sician or sur<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">eon<\/span><span style=\"font-weight: 400\">;<\/span><span style=\"font-weight: 400\"> or<\/span><\/a><\/li>\n<li><a href=\"https:\/\/statutes.capitol.texas.gov\/docs\/OC\/htm\/OC.151.htm#:~:text=(13)%20%20%22Practicing%20medicine,for%20those%20services.\"><b>directl<\/b><b>y<\/b><b> or indirectl<\/b><b>y<\/b><span style=\"font-weight: 400\"> char<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">es mone<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> or other compensation for those services.\u201d<\/span> <\/a><span style=\"font-weight: 400\">(Tex. <\/span>Occ. Code \u00a7 151.002(13).)<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400\">Although Musk has held out Grok as being competent to interpret medical information, he has made no claims that Grok is a licensed doctor. <\/span><strong><i>However<\/i>, <\/strong><b>access to Grok is a feature exclusive to paid Twitter users<\/b><span style=\"font-weight: 400\">, meaning that money is being (indirectly) charged for the provision of services. This makes Grok\u2019s services, by definition, paid.<\/span><\/p>\n<p><b>Grok\u2019s interpretation of medical scans and results counts as the practice of medicine.<\/b><span style=\"font-weight: 400\"> In <\/span><i><span style=\"font-weight: 400\">Lowry v. Texas Medical Board<\/span><\/i><span style=\"font-weight: 400\"> (2021), the Texas 3rd Court of Appeals <\/span><a href=\"https:\/\/casetext.com\/case\/lowry-v-tex-med-bd#:~:text=In%20February%202015,in%20Osteopathic%20Medicine.\"><span style=\"font-weight: 400\">found that a former ph<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">sician who was bein<\/span><span style=\"font-weight: 400\">g <\/span><span style=\"font-weight: 400\">consulted with b<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> a licensed ph<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">sician to \u201cinterpret\u201d patients\u2019 EEG results was<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> indeed, practicin<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\"> medicine within the meanin<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\"> of Texas state statute<\/span><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> even thou<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">h he had no direct contact with patients.<\/span> <\/a><span style=\"font-weight: 400\">(<\/span><i><span style=\"font-weight: 400\">Lowry v. <\/span><\/i><i><span style=\"font-weight: 400\">Texas Medical Board<\/span><\/i><span style=\"font-weight: 400\">, 2021 Tex. App. LEXIS 4656, at *13-14.)<\/span><\/p>\n<p><b>Grok\u2019s actions also can be easily construed as the <\/b><b><i>corporate<\/i><\/b><b> practice of medicine.<\/b><span style=\"font-weight: 400\"> In fact, it is quite difficult to construe them as anything else. Similar to the legal profession\u2019s ban on non-lawyers having ownership interests in law firms, Texas law <\/span><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/OC\/htm\/OC.164.htm#:~:text=(17)%20%20directly%20or%20indirectly%20aids%20or%20abets%20the%20practice%20of%20medicine%20by%20a%20person%2C%20partnership%2C%20association%2C%20or%20corporation%20that%20is%20not%20licensed%20to%20practice%20medicine%20by%20the%20board%3B\"><span style=\"font-weight: 400\">explicitl<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> prohibits the corporate practice of medicine<\/span><\/a><span style=\"font-weight: 400\">, on grounds that doing so would potentially influence the professional judgment of doctors. (Tex. Occ. Code Ann. 164.052(a)(17)) In <\/span><i><span style=\"font-weight: 400\">Gupta v. Eastern Idaho Tumor Institute<\/span><\/i><span style=\"font-weight: 400\">, the 14th District held that a joint venture between an oncologist and a corporation to operate a cancer treatment center was not in violation of state law because the arrangement posed no risk of affecting the doctor\u2019s professional judgment. (140 S.W.3d 747 (Tex. App. Houston 14th 2004)) However, as an AI construct, Grok\u2019s fundamental \u201cjudgment\u201d (if such a characteristic can truly be ascribed to an AI) is <\/span><i><span style=\"font-weight: 400\">quite literally in the hands of Twitter<\/span><\/i><span style=\"font-weight: 400\">, a corporate entity not licensed to practice medicine. If we interpret Grok as \u201cpracticing medicine,\u201d this is facially illegal.<\/span><\/p>\n<p><a href=\"https:\/\/byrdadatto.com\/banter\/can-non-doctors-own-a-medical-practice-in-texas-texas-corporate-practice-of-medicine-field-guide-part-2-of-5\/#:~:text=Some%20attorneys%20and%20businesses%20have%20taken%20the%20position,for%20non%2Ddoctor%20owned%20LLCs%20to%20practice%20medicine.\"><span style=\"font-weight: 400\">(It should be noted that while some have read Texas statute to permit the practice of medicine b<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> LLCs, <\/span><\/a><span style=\"font-weight: 400\">there are a number of instances of <\/span><a href=\"https:\/\/byrdadatto.com\/banter\/can-non-doctors-own-a-medical-practice-in-texas-texas-corporate-practice-of-medicine-field-guide-part-3-of-5\/\"><span style=\"font-weight: 400\">LLCs bein<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\"> prosecuted for doin<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\"> precisel<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> this.<\/span><\/a><span style=\"font-weight: 400\">)<\/span><\/p>\n<h3><b>Possible (Future) Unauthorized Practice of Law<\/b><\/h3>\n<p><b>Advertising Grok as being capable of reading legal documents also carries significant risk of constituting the unauthorized practice of law.<\/b><span style=\"font-weight: 400\"> Though it remains to be seen as to exactly how Musk plans to implement the \u201clegal analysis\u201d feature into the AI model, <\/span><b>if its actions rose to the level of constituting the practice of law, it would likely run afoul of Rule 5.4(d)(3) of the ABA Model Rules of Professional Conduct,<\/b><span style=\"font-weight: 400\"> for the same reasons Grok\u2019s current actions potentially constitute the corporate practice of medicine. <\/span><a href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_5_4_professional_independence_of_a_lawyer\/#:~:text=(3)%20a%20nonlawyer%20has%20the%20right%20to%20direct%20or%20control%20the%20professional%20judgment%20of%20a%20lawyer.\"><span style=\"font-weight: 400\">5.4(d) (3<\/span><span style=\"font-weight: 400\">)<\/span><span style=\"font-weight: 400\"> forbids le<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">al practice in an<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\"> form where a non-law<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">er has control over the professional <\/span><span style=\"font-weight: 400\">j<\/span><span style=\"font-weight: 400\">ud<\/span><span style=\"font-weight: 400\">g<\/span><span style=\"font-weight: 400\">ment of a law<\/span><span style=\"font-weight: 400\">y<\/span><span style=\"font-weight: 400\">er.<\/span> <\/a><span style=\"font-weight: 400\">Though Grok is obviously not a lawyer, such an arrangement would clearly go against the intent of the law.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>Matthew Sparks was a Justice
