To the children and teens using them, these technologies are not an experiment, even if companies still treat them like one. As chatbots are deployed to hundreds of millions of kids and teens, there have been <\/span><a href=\"https:\/\/www.law.georgetown.edu\/tech-institute\/insights\/ai-sycophancy-impacts-harms-questions\/\"><span style=\"font-weight: 400;\">widespread documented harms<\/span><\/a><span style=\"font-weight: 400;\"> including <\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/aug\/03\/ai-chatbot-as-therapy-alternative-mental-health-crises-ntwnfb\"><span style=\"font-weight: 400;\">mental health issues<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.consumerfinance.gov\/data-research\/research-reports\/chatbots-in-consumer-finance\/chatbots-in-consumer-finance\"><span style=\"font-weight: 400;\">financial<\/span><\/a> <a href=\"https:\/\/venturebeat.com\/ai\/openai-rolls-back-chatgpts-sycophancy-and-explains-what-went-wrong\"><span style=\"font-weight: 400;\">harm<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.brookings.edu\/articles\/breaking-the-ai-mirror\/\"><span style=\"font-weight: 400;\">medical harm<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/arxiv.org\/abs\/2504.18412\"><span style=\"font-weight: 400;\">emotional<\/span><\/a> <a href=\"https:\/\/www.axios.com\/2025\/07\/07\/ai-sycophancy-chatbots-mental-health\"><span style=\"font-weight: 400;\">dependence<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.cnet.com\/tech\/services-and-software\/i-asked-ai-chatbots-about-problem-gambling-then-they-gave-me-betting-advice\/\"><span style=\"font-weight: 400;\">manipulation and deception<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.wired.com\/story\/ai-psychosis-is-rarely-psychosis-at-all\/\"><span style=\"font-weight: 400;\">psychosis<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.nytimes.com\/2025\/08\/08\/technology\/ai-chatbots-delusions-chatgpt.html\"><span style=\"font-weight: 400;\">delusional thinking<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/med.stanford.edu\/news\/insights\/2025\/08\/ai-chatbots-kids-teens-artificial-intelligence.html\"><span style=\"font-weight: 400;\">self-harm<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.silicon.co.uk\/e-innovation\/artificial-intelligence\/ai-committee-harm-626708\"><span style=\"font-weight: 400;\">suicide<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/arxiv.org\/abs\/2508.13743\"><span style=\"font-weight: 400;\">bias<\/span><\/a> <a href=\"https:\/\/www.wsj.com\/tech\/ai\/ai-chatbot-agree-flatter-users-1787e1a7\"><span style=\"font-weight: 400;\">reinforcement<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/openai.com\/index\/expanding-on-sycophancy\/\"><span style=\"font-weight: 400;\">anger or impulsive actions<\/span><\/a><span style=\"font-weight: 400;\">. Enforcers and policymakers now face a familiar challenge: applying longstanding laws to emerging technologies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Recognizing the urgency of these issues, we\u2019ve come together \u2013 a team of privacy experts and former enforcers \u2013 to outline how existing laws can meet emerging AI risks to kids and teens. The \u201c<\/span><a href=\"https:\/\/docs.google.com\/document\/d\/1Br9Bz41-1nvp6hO5Dw1ru2m-nx0Y7eM3ACfCKmVqYpY\/edit?usp=sharing\"><span style=\"font-weight: 400;\">How Existing Laws Apply to AI Chatbots<\/span><i><span style=\"font-weight: 400;\"> for Kids and Teens<\/span><\/i><\/a><span style=\"font-weight: 400;\">\u201d reference guide offers a practical overview of how existing legal frameworks can address emerging risks associated with chatbots used by or directed toward minors.\u00a0<\/span><\/p>\n<h2><b>It underscores a key point: <\/b><b>There is no AI exemption in the law<\/b><b>. Federal and state consumer protection, data privacy, and data security statutes continue to apply, even as \u201cnew\u201d technologies reshape how harms manifest in our lives.<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">This resource synthesizes current enforcement themes across jurisdictions, highlighting how federal and state privacy, data breach, and unfair or deceptive practices (UDAP) laws can be used to tackle chatbot-related harms \u2013 from targeted advertising and data monetization to deceptive marketing and the misuse of AI for therapeutic treatment. Drawing from recent regulatory and enforcement actions, the guide identifies key legal concepts and existing authorities relevant to enforcers, including:<\/span><\/p>\n<ul style=\"margin: 0 0 0 20px; padding: 0; line-height: 1;\">\n<li style=\"font-weight: 400; margin: 0;\"><span style=\"font-weight: 400;\">Restrictions on targeted ads and data selling or sharing involving minors under state privacy laws.<\/span><\/li>\n<li style=\"font-weight: 400; margin: 0;\"><span style=\"font-weight: 400;\">COPPA obligations for data collection, retention, and parental consent.<\/span><\/li>\n<li style=\"font-weight: 400; margin: 0;\"><span style=\"font-weight: 400;\">The use of UDAP authorities to challenge unfair or deceptive representations or practices around chatbot safety or capabilities.<\/span><\/li>\n<li style=\"font-weight: 400; margin: 0;\"><span style=\"font-weight: 400;\">State-level initiatives governing AI mental health tools and \u201ccompanion\u201d chatbots.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The resource is not an exhaustive 50-state survey, but a practical starting point for enforcement teams and policy staff. It helps enforcers confronting chatbot-related harms to draw on a wide range of legal authorities, for instance, by examining whether broad data collection practices implicate both consumer protection and children\u2019s privacy statutes. While this resource focuses on combatting chatbot harms that affect kids and teens, we recognize other pressing areas where chatbots have caused harm, including abuse of health and biometric data, irresponsible handling of sensitive information, or deceptive or misleading chatbot interactions. We hope to explore these topics in the future.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As kids and teens are increasingly exposed to chatbots marketed by companies with a well-documented history of reckless and <\/span><a href=\"https:\/\/www.cdc.gov\/mmwr\/volumes\/73\/su\/su7304a3.htm\"><span style=\"font-weight: 400;\">sometimes deadly<\/span><\/a><span style=\"font-weight: 400;\"> conduct, understanding how existing laws map onto AI systems is essential.
