Herrera v. Cleveland
ICAP represented a pre-trial detainee seeking the Supreme Court’s review of a court of appeals’ decision rejecting his request to amend his civil rights complaint to name the three prison guards who allowed him to be brutally attacked in his cell. The decision implicates a circuit split over whether Federal Rule of Civil Procedure 15(c)(1)(C) excludes relation back of an amended complaint to the date of the original complaint if the original complaint names John Doe placeholders as defendants due to inadequate knowledge regarding the defendants’ names.
