Director Mark Gaston Pierce: Hot Shoppes Was a Misstep

WRI Director Mark Gaston Pearce comments, in a Law360 piece, in support of the NLRB General Counsel's proposal to overturn Hot Shoppes, the longstanding Board precedent interpreting the Supreme Court's decision in Labor Board v. Mackay Radio. Hot Shoppes stands for the proposition that employers may permanently replace striking employees provided they do not have "an independent unlawful purpose."
