In this panel, speakers will analyze and discuss the impact of the four favorable arbitral awards that Colombia has received during 2021 in light of the future of the Investment Law Regime in Latin America.  What are the lessons learned that could be applied to ongoing efforts of systemic change of the Investor-State Dispute Settlement System (ISDS) in the region? What are the effects of these awards on domestic regulatory efforts? Which legal and fiscal regulatory efforts should countries explore to strengthen their capacity to mitigate potential damages? The panel will include the participation of Latin American government officials and academic experts in international investment arbitration. It will be conducted in Spanish. No English translation will be available.

Este panel discutirá el impacto a futuro en el Derecho Internacional de la Inversión Extranjera en Latinoamérica de los cuatro laudos internacionales a favor de Colombia en 2021. ¿Qué lecciones deja este resultado frente a los esfuerzos de cambio sistémico en el sistema de controversias inversionista-Estado en la región?, ¿Cuáles son los efectos de estos laudos en la actividad regulatoria del Estado? y, ¿Cuáles son las medidas que los países podrían tomar para fortalecer su capacidad para prevenir una afectación en sus esfuerzos fiscales y regulatorios? El conversatorio contará con la participación de funcionarios públicos y académicos expertos en arbitraje internacional de inversión en América Latina y será realizado únicamente en idioma español. No se ofrecerá traducción simultánea al inglés.
