State of Minnesota v. U.S. Department of Justice

ICAP has partnered with the Hennepin County Attorney and Minnesota Attorney General to challenge the federal government’s attempt to block access to key evidence in the shootings by federal agents during “Operation Metro Surge.” In January 2026, federal immigration officers shot and killed two people on public streets and shot and wounded a third person in front of his home. At the scene of two of the shootings–the killing of Renee Good and the shooting of Julio Cesar Sosa-Celis–federal agents initially indicated that they would follow the longstanding practice of cooperation between federal and state authorities and share relevant information. Minnesota investigators began their work under this presumption. But federal authorities soon reneged their pledge to cooperate, taking exclusive possession of collected evidence and denying Minnesota investigators access to key information. At the scene of the third incident–the killing of Alex Pretti–federal authorities refused cooperation from the start and physically blocked the Minnesota Bureau of Criminal Apprehension investigators from accessing the crime scene. In order to conduct state criminal investigations into all three shootings, Minnesota state officials formally requested that the DHS and the DOJ provide access to evidence for each incident. Federal authorities continue to refuse cooperation. ICAP is working alongside Attorney General Keith Ellison, County Attorney Mary Moriarty, and the Washington Litigation Group to investigate and litigate these matters and has asked the Court to enforce compliance with the investigative demands of Minnesota authorities.
