State v. New Mexico Civil Guard
In July 2020, ICAP partnered with then-Bernalillo County District Attorney Raúl Torrez to file a civil suit against the New Mexico Civil Guard for its actions during a protest at the statue of Spanish conquistador, Juan de Oñate, in Albuquerque. The suit challenged the Guard as violating New Mexico state law against unlawful paramilitary and law enforcement activity. In October 2022, ICAP prevailed, obtaining an injunction ordering the Guard and its members to stop operating as a military unit or acting as law enforcement.

- 4/11/22 – Filed a motion for default judgment and contempt of court for failing to comply with a court-ordered deposition, and for spoliation sanctions for destroying evidence
- 11/15/21 – Filed a petition and declaration in support to enforce a subpoena against Facebook to obtain non-content defendant-related information
- 9/13/21 – Prevailed against a motion for judgment on the pleadings on all of our state law legal theories
- 3/1/21 – Filed an opposition to Defendants’ motion for judgment on the pleadings
- 7/13/20 – Filed a complaint in Albuquerque invoking New Mexico’s anti-militia and anti-paramilitary laws to prevent the return of unlawful private paramilitaries to New Mexico
