State v. New Mexico Civil Guard
ICAP has partnered with Bernalillo County District Attorney Raúl Torrez to file a civil suit against the New Mexico Civil Guard for its actions during a protest at the statue of Spanish conquistador, Juan de Oñate, in Albuquerque. The suit challenges the group as violating New Mexico state law against unlawful paramilitary and law enforcement activity.

- 4/11/22 – Filed a motion for default judgment and contempt of court for failing to comply with a court-ordered deposition, and for spoliation sanctions for destroying evidence
- 11/15/21 – Filed a petition and declaration in support to enforce a subpoena against Facebook to obtain non-content defendant-related information
- 9/13/21 – Prevailed against a motion for judgment on the pleadings on all of our state law legal theories
- 3/1/21 – Filed an opposition to Defendants’ motion for judgment on the pleadings
- 7/13/20 – Filed a complaint in Albuquerque invoking New Mexico’s anti-militia and anti-paramilitary laws to prevent the return of unlawful private paramilitaries to New Mexico
