Cristosal Human Rights v. Peter Marocco
ICAP represents the grantees of the Inter-American Foundation (IAF), a federal agency that focuses on community-driven development across Latin America and the Caribbean. IAF has invested in nearly 6,000 community development projects in 35 counties, working to address the root causes of migration by promoting economic stability, reducing violence, and strengthening democratic governance. The Foundation was originally created by Congress and has maintained bipartisan Congressional support since its inception.
Despite the Foundation's long history of bipartisan Congressional support and achievements, the IAF was targeted in an Executive Order calling for the dismantling of the Foundation. The Executive Branch has since made sweeping efforts to dismantle the Foundation, including canceling contracts and grants and placing all employees on administrative leave. We represent the grantees whose agreements were unlawfully terminated. Our suit alleges that the Executive Branch's efforts to dismantle the IAF violate the Separation of Powers; constitute ultra vires actions and thus are void and without effect; and violate the Administration Procedure Act (APA).
