CASA v. Kristi Noem & United States Department of Homeland Security
ICAP, on behalf of CASA, Inc., is challenging U.S. Secretary of Homeland Security Kristi Noem’s unlawful attempt to terminate the Temporary Protected Status (TPS) designations for Afghanistan and Cameroon. In 2022, individuals from Afghanistan and Cameroon received this status in response to prolonged armed conflicts, hunger, and human rights abuses affecting their countries which was later extended and has allowed thousands of Afghans and Cameroonians to lawfully live and work in the United States.
We argue that the attempted termination of this status violates required procedures outlined in the TPS statute and is, at least in part, driven by racial animus in violation of the Constitution’s guarantee of equal protection under the law. We represent CASA and their nearly 6,000 Afghan and Cameroonian members in challenging this unlawful attempt by the Department of Homeland Security.

- 7/21/25 – Received a decision from the U.S. Court of Appeals for the Fourth Circuit agreeing with the district court that CASA had stated a plausible claim for relief, but concluding that preliminary evidence was insufficient to grant an emergency motion for postponement of agency action

- 7/14/25 – Filed an emergency motion for postponement of agency action pending appeal in the U.S. Court of Appeals for the Fourth Circuit requesting an administrative stay of agency action
- 7/10/25 – Received a decision from the U.S. District Court of Maryland which recognized CASA’s strong preliminary evidence that the terminations were unlawful, but finding that further factual development was necessary before relief could be granted
- 6/10/25 – Filed reply brief in support of the previously filed motion for partial summary judgment or a stay of agency action and opposed the Government’s cross-motion to dismiss or for partial summary judgment
