Ermold v. Davis
ICAP represents a same-sex couple, David Ermold and David Moore, who sought to obtain a marriage license following the Supreme Court's landmark decision in Obergefell v. Hodges, 576 U.S. 644 (2015), which recognized that same-sex couples enjoy the fundamental right to marry. In defiance of the Supreme Court's decision, Defendant Kim Davis, then the clerk of Rowan County, Kentucky, refused to give Plaintiffs a license based on her religious beliefs. A jury awarded Plaintiffs damages for the emotional distress they endured, and ICAP represents them on appeal.

Hodges and to establish a First Amendment right to engage in state action that violates the constitutional rights of private citizens
- 3/6/25 – Obtained a decision from the Sixth Circuit affirming the lower court decision that the Plaintiffs’ constitutional right to marry was violated
