Professor Micallef is a Partner in the Intellectual Property Group of Sildey Austin LLP, Washington DC office.


Professor Micallef represents clients with all types of intellectual property needs in many different circumstances. His litigation experience includes all phases of litigation, from commencement of suit, through fact and expert discovery, motion practice and trial, and he has appeared before Federal District and Appellate courts, federal agencies and private arbitration panels. His case work has involved innovations in such cutting-edge technologies as computer microarchitecture, multiprocessor computer systems, SDRAM circuit design, semiconductor fabrication techniques, cellular communications technology, satellite television, computer graphics and voice messaging systems.


For example, Professor Micallef helped defend Intel Corporation against charges of patent infringement and antitrust violations in Intergraph Corp. v. Intel Corp., has recently assisted Dell, Inc. in defending against charges of infringement of twelve different patents in Lucent Technologies, Inc. v. Dell Computer Corporation and has represented Microsoft Corporation in various patent litigations. He has also represented Pause Technologies on appeal in Pause Technologies, L.L.C. v. TiVo, Inc. He has aided clients in obtaining patents from the United States Patent and Trademark Office in such diverse technologies as computer disk drives, micro-endoscopes and archery equipment and he has counseled clients in the acquisition of existing patents through purchase, and the transfer of patented technology from individual inventors to small, startup companies. He has also provided clients advice on issues of implied license, the interface between the patent and antitrust laws, and opinions on the validity, infringement and enforceability of various patents. Professor Micallef has represented numerous clients, both large and small, in the investigation of possible and alleged infringement and the assertion of intellectual property rights in courts throughout the United States.


Prior to joining Sidley Austin, Professor Micallef was a Partner in the Washington, DC, offices of Arnold & Porter, and before that of Howrey, Simon, Arnold & White.  Prior to that he practiced in both the New York and DC offices of Kenyon & Kenyon. Before joining Kenyon & Kenyon, he clerked for the Honorable Joseph T. Walsh, Associate Justice, Supreme Court of Delaware, where he was exposed to numerous corporate and business law issues, among others. He is admitted to practice before the Supreme Court of Virginia, the Supreme Court of Delaware, the Court of Appeals of the District of Columbia, the United States Court of Appeals for the Federal Circuit, the United States District Court for the Eastern District of Virginia and the United States Patent and Trademark Office. He has also co-edited two editions of Duval, Unfair Competition and the ITC and has authored several articles on patent related topics.
